137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Title 8, Insurance Code, is amended by adding
159 Subtitle L to read as follows:
1610 SUBTITLE L. QUALIFIED HEALTH PLAN MANDATORY DISCLOSURES
1711 CHAPTER 1693. QUALIFIED HEALTH PLAN IDENTIFICATION CARDS
1812 Sec. 1693.001. DEFINITIONS. Except as provided by Section
1913 1693.003, in this chapter, "enrollee," "exchange," "qualified
2014 health plan," and "qualified health plan issuer" have the meanings
2115 assigned by 45 C.F.R. Section 155.20 as that section existed on
2216 January 1, 2015.
2317 Sec. 1693.002. REQUIRED INFORMATION. An identification
2418 card or other similar document issued by a qualified health plan
2519 issuer to an enrollee of a qualified health plan purchased through
2620 an exchange must, in addition to any requirement under other law,
2721 including Sections 843.209, 1301.162, and 1369.153, display on the
2822 card or document in a location of the issuer's choice the acronym
2923 "QHP."
3024 Sec. 1693.003. COMMISSIONER DETERMINATIONS REGARDING
3125 FEDERAL REGULATIONS. (a) The commissioner shall monitor 45 C.F.R.
3226 Section 155.20 for amendments to the definitions listed in Section
3327 1693.001 and determine if it is in the best interest of the state to
3428 adopt an amended definition for purposes of this chapter. If the
3529 commissioner determines that it is in the best interest of the state
3630 to adopt the amended definition, the commissioner by rule shall
3731 adopt the amended definition.
3832 (b) In making the determination about an amendment, the
3933 commissioner shall consider, in addition to other factors
4034 affecting the public interest, the beneficial and adverse effects
4135 the amendment may have on:
4236 (1) individuals who are receiving medical care and
4337 health care services in this state; and
4438 (2) health care providers and physicians.
4539 Sec. 1693.004. REPORT TO LEGISLATURE. The commissioner
4640 shall prepare a report of a determination made under Section
4741 1693.003, including an explanation of the reasons for the
4842 determination, and file the report with the presiding officer of
4943 each house of the legislature not later than the 30th day after the
5044 date the determination is made.
5145 Sec. 1693.005. RULES. The commissioner may adopt rules as
5246 necessary to administer and enforce this chapter.
5347 SECTION 2. This Act takes effect September 1, 2015.
