8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subsection (b) of Sec. 85.061, Health and Safety |
---|
10 | 10 | | Code, is amended to read as follows: |

11 | 11 | | Sec. 85.061. HIV MEDICATION PROGRAM. (a) The Texas HIV |
---|
12 | 12 | | medication program is established in the department. |
---|
13 | 13 | | (b) (1) The program shall assist hospital districts, local |
---|
14 | 14 | | health departments, public or nonprofit hospitals and clinics, |
---|
15 | 15 | | nonprofit community organizations, and HIV-infected individuals in |
---|
16 | 16 | | the purchase of medications approved by the board that have been |
---|
17 | 17 | | shown to be effective in reducing hospitalizations due to |
---|
18 | 18 | | HIV-related conditions. |
---|
19 | 19 | | (2) Out of funding available under Subchapter C and D, |
---|
20 | 20 | | the program shall assist in the provision of discharge planning and |
---|
21 | 21 | | transitional primary care and social support services to |
---|
22 | 22 | | HIV-infected individuals in the custody of a local county jail in a |
---|
23 | 23 | | county with a population of 3.3 million or more who are nearing |
---|
24 | 24 | | release or whose incarceration is of a short duration. |
---|
25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
---|
26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
---|
27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
---|
29 | 29 | | Act takes effect September 1, 2015. |
