55 AN ACT
66 relating to the provision of services to certain HIV-infected
77 individuals.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsection (b) of Sec. 85.061, Health and Safety
1010 Code, is amended to read as follows:
1111 Sec. 85.061. HIV MEDICATION PROGRAM. (a) The Texas HIV
1212 medication program is established in the department.
1313 (b) (1) The program shall assist hospital districts, local
1414 health departments, public or nonprofit hospitals and clinics,
1515 nonprofit community organizations, and HIV-infected individuals in
1616 the purchase of medications approved by the board that have been
1717 shown to be effective in reducing hospitalizations due to
1818 HIV-related conditions.
1919 (2) Out of funding available under Subchapter C and D,
2020 the program shall assist in the provision of discharge planning and
2121 transitional primary care and social support services to
2222 HIV-infected individuals in the custody of a local county jail in a
2323 county with a population of 3.3 million or more who are nearing
2424 release or whose incarceration is of a short duration.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2015.
