11 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 11 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
---|
13 | 12 | | amended by adding Section 531.0999 to read as follows: |
---|
14 | 13 | | Sec. 531.0999. PEER SPECIALISTS. With input from peer |
---|
15 | 14 | | specialists, state-approved organizations that certify peer |
---|
16 | 15 | | specialists, and other relevant stakeholders, the commission shall |
---|
17 | 16 | | develop and the executive commissioner shall adopt: |
---|
18 | 17 | | (1) rules that establish training requirements for |
---|
19 | 18 | | peer specialists so that they are able to provide services to |
---|
20 | 19 | | persons with mental illness and services to persons with substance |
---|
21 | 20 | | use conditions; |
---|
22 | 21 | | (2) rules that establish certification and |
---|
23 | 22 | | supervision requirements for peer specialists; |
---|
24 | 23 | | (3) rules that define the scope of services that peer |
---|
25 | 24 | | specialists may provide; |
---|
26 | 25 | | (4) rules that distinguish peer services from other |
---|
27 | 26 | | services that a person must hold a license to provide; and |
---|
28 | 27 | | (5) any other rules necessary to protect the health |
---|
29 | 28 | | and safety of persons receiving peer services. |
---|
30 | 29 | | SECTION 2. Section 32.024, Human Resources Code, is amended |
---|
31 | 30 | | by adding Subsections (nn) and (oo) to read as follows: |
---|
37 | 36 | | type for peer specialists for purposes of enrollment as providers |
---|
38 | 37 | | of and reimbursement under the medical assistance program. |
---|
39 | 38 | | SECTION 3. As soon as practicable after the effective date |
---|
40 | 39 | | of this Act, the executive commissioner of the Health and Human |
---|
41 | 40 | | Services Commission shall adopt the rules required by Section |
---|
42 | 41 | | 531.0999, Government Code, as added by this Act. |
---|
43 | 42 | | SECTION 4. As soon as practicable after the effective date |
---|
44 | 43 | | of this Act, the Health and Human Services Commission shall |
---|
45 | 44 | | establish and implement a separate provider type for peer |
---|
46 | 45 | | specialists as required by Section 32.024(oo), Human Resources |
---|
47 | 46 | | Code, as added by this Act. |
---|
48 | 47 | | SECTION 5. If before implementing any provision of this Act |
---|
49 | 48 | | a state agency determines that a waiver or authorization from a |
---|
50 | 49 | | federal agency is necessary for implementation of that provision, |
---|
51 | 50 | | the agency affected by the provision shall request the waiver or |
---|
52 | 51 | | authorization and may delay implementing that provision until the |
---|
53 | 52 | | waiver or authorization is granted. |
---|
54 | 53 | | SECTION 6. This Act takes effect immediately if it receives |
---|
55 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 57 | | Act takes effect September 1, 2015. |
