A BILL TO BE ENTITLED
AN ACT
relating to the release of a motor vehicle accident report.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 550.065, Transportation Code, is amended
by adding Subsections (c-1) and (c-2) to read as follows:
(c-1) Except as provided by Subsection (c-2), the
department or the governmental entity must redact the following
information before releasing the information under Subsection
(c)(4):
(1) the driver's license number, date of birth, and
address of any person involved in the accident; and
(2) the license plate number and vehicle
identification number of any vehicle involved in the accident.
(c-2) Subsection (c-1) does not apply to information
released to:
(1) a person who is involved in the accident or a legal
guardian of that person if the person is younger than 18 years of
age;
(2) a person who has established financial
responsibility for a vehicle involved in the accident in a manner
described by Section 601.051, including a policyholder of a motor
vehicle liability insurance policy covering the vehicle;
(3) an insurance company that issued a motor vehicle
liability insurance policy covering a vehicle involved in the
accident; or
(4) an attorney representing a person who is involved
in the accident.
SECTION 2. This Act takes effect September 1, 2015.
