285 relating to the allocation and use of the proceeds from taxes
296 imposed on the sale, storage, or use of sporting goods.
307 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
318 SECTION 1. Sections 151.801(c) and (c-1), Tax Code, are
329 amended to read as follows:
3310 (c) The [Subject to Subsection (c-1), the] proceeds from the
3411 collection of the taxes imposed by this chapter on the sale,
3512 storage, or use of sporting goods shall be deposited as follows:
3613 (1) an amount equal to 94 percent of the proceeds shall
3714 be credited to the Parks and Wildlife Department and deposited as
3815 specified in the Parks and Wildlife Code; and
3916 (2) an amount equal to six percent of the proceeds
4017 shall be credited to the Texas Historical Commission and deposited
4118 as specified in Section 442.073, Government Code.
4219 (c-1) Money credited to Parks and Wildlife Department
4320 accounts under Subsection (c) may be appropriated only:
4421 (1) to acquire, operate, maintain, and make capital
4522 improvements to parks;
4623 (2) for a purpose authorized under Chapter 24, Parks
4724 and Wildlife Code; and
4825 (3) [Except as provided by this subsection, the
4926 comptroller may not credit to the Parks and Wildlife Department or
5027 the Texas Historical Commission any amounts under this section that
5128 are in excess of the amounts appropriated to the department or
5229 commission for that biennium. In addition to amounts appropriated
5330 to the Parks and Wildlife Department from the proceeds described by
5431 Subsection (c), the comptroller shall transfer to appropriate
5532 department accounts amounts from those proceeds sufficient] to fund
5633 the state contributions for employee benefits of Parks and Wildlife
5734 Department employees whose salaries or wages are paid from those
5835 department accounts [receiving the transfers].
5936 SECTION 2. This Act takes effect September 1, 2015.
