| 8 | 8 | | used to execute a person convicted of capital murder. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article 43.14, Code of Criminal Procedure, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Art. 43.14. EXECUTION OF PERSON CONVICTED OF CAPITAL MURDER |
|---|
| 13 | 13 | | [CONVICT]. (a) Whenever the sentence of death is pronounced |
|---|
| 14 | 14 | | against a person convicted of capital murder [convict], the |
|---|
| 15 | 15 | | sentence shall be executed at any time after the hour of 6 p.m. on |
|---|
| 16 | 16 | | the day set for the execution, by intravenous injection of a |
|---|
| 17 | 17 | | substance or substances in a lethal quantity sufficient to cause |
|---|
| 18 | 18 | | death and until the person [such convict] is dead, such execution |
|---|
| 19 | 19 | | procedure to be determined and supervised by the director of the |
|---|
| 20 | 20 | | correctional institutions division of the Texas Department of |
|---|
| 21 | 21 | | Criminal Justice. |
|---|
| 22 | 22 | | (b) Except as provided by Subsection (c), not later than the |
|---|
| 23 | 23 | | 45th day before the date an execution is scheduled to occur, the |
|---|
| 24 | 24 | | director of the correctional institutions division of the Texas |
|---|
| 25 | 25 | | Department of Criminal Justice shall post on the department's |
|---|
| 26 | 26 | | Internet website the following information regarding each |
|---|
| 27 | 27 | | substance to be used in the execution: |
|---|
| 28 | 28 | | (1) the name of the substance; |
|---|
| 29 | 29 | | (2) the manufacturer of the substance; |
|---|
| 30 | 30 | | (3) the expiration date of the substance; |
|---|
| 31 | 31 | | (4) the results of any laboratory tests performed on |
|---|
| 32 | 32 | | the substance; |
|---|
| 33 | 33 | | (5) the quantity of the substance; and |
|---|
| 34 | 34 | | (6) any other information in the department's |
|---|
| 35 | 35 | | possession regarding the substance. |
|---|
| 36 | 36 | | (c) If the information described by Subsection (b) is not |
|---|
| 37 | 37 | | available for the department to post before the date required by |
|---|
| 38 | 38 | | Subsection (b), the department shall make the information available |
|---|
| 39 | 39 | | as soon as the substance is in the department's possession, but in |
|---|
| 40 | 40 | | no event later than the 14th day before the date the execution is |
|---|
| 41 | 41 | | scheduled to occur. |
|---|
| 42 | 42 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2015. |
