55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to disclosing certain information about each substance
88 used to execute a person convicted of capital murder.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 43.14, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 43.14. EXECUTION OF PERSON CONVICTED OF CAPITAL MURDER
1313 [CONVICT]. (a) Whenever the sentence of death is pronounced
1414 against a person convicted of capital murder [convict], the
1515 sentence shall be executed at any time after the hour of 6 p.m. on
1616 the day set for the execution, by intravenous injection of a
1717 substance or substances in a lethal quantity sufficient to cause
1818 death and until the person [such convict] is dead, such execution
1919 procedure to be determined and supervised by the director of the
2020 correctional institutions division of the Texas Department of
2121 Criminal Justice.
2222 (b) Except as provided by Subsection (c), not later than the
2323 45th day before the date an execution is scheduled to occur, the
2424 director of the correctional institutions division of the Texas
2525 Department of Criminal Justice shall post on the department's
2626 Internet website the following information regarding each
2727 substance to be used in the execution:
2828 (1) the name of the substance;
2929 (2) the manufacturer of the substance;
3030 (3) the expiration date of the substance;
3131 (4) the results of any laboratory tests performed on
3232 the substance;
3333 (5) the quantity of the substance; and
3434 (6) any other information in the department's
3535 possession regarding the substance.
3636 (c) If the information described by Subsection (b) is not
3737 available for the department to post before the date required by
3838 Subsection (b), the department shall make the information available
3939 as soon as the substance is in the department's possession, but in
4040 no event later than the 14th day before the date the execution is
4141 scheduled to occur.
4242 SECTION 2. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2015.
