| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 38.0021 to read as follows: |
|---|
| 12 | 12 | | Sec. 38.0021. NOTIFICATION OF PARENTS REGARDING STUDENT |
|---|
| 13 | 13 | | IMMUNIZATION STATUS. (a) Except as provided by Subsection (c), |
|---|
| 14 | 14 | | each school year a public school shall provide written notification |
|---|
| 15 | 15 | | regarding the immunization status of children enrolled at the |
|---|
| 16 | 16 | | school to the parent of each child enrolled at the school. |
|---|
| 17 | 17 | | (b) The notification: |
|---|
| 18 | 18 | | (1) must be provided not later than November 1; |
|---|
| 19 | 19 | | (2) must inform the parent of the number of students |
|---|
| 20 | 20 | | enrolled at the school who have not obtained the immunizations |
|---|
| 21 | 21 | | required for that school year by the Department of State Health |
|---|
| 22 | 22 | | Services under Section 38.001(b-1); and |
|---|
| 23 | 23 | | (3) may not provide information regarding the |
|---|
| 24 | 24 | | immunization status of specific students. |
|---|
| 25 | 25 | | (c) A public school is not required to provide the |
|---|
| 26 | 26 | | notification if each student at the school has obtained all |
|---|
| 27 | 27 | | immunizations required for that school year by the Department of |
|---|
| 28 | 28 | | State Health Services under Section 38.001(b-1). |
|---|
| 29 | 29 | | (d) The commissioner may adopt rules necessary to implement |
|---|
| 30 | 30 | | this section. |
|---|
| 31 | 31 | | SECTION 2. This Act applies beginning with the 2015-2016 |
|---|
| 32 | 32 | | school year. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2015. |
