84R9603 KKA-D By: Blanco H.B. No. 1593 A BILL TO BE ENTITLED AN ACT relating to notification of parents regarding the immunization status of students enrolled at a public school. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 38, Education Code, is amended by adding Section 38.0021 to read as follows: Sec. 38.0021. NOTIFICATION OF PARENTS REGARDING STUDENT IMMUNIZATION STATUS. (a) Except as provided by Subsection (c), each school year a public school shall provide written notification regarding the immunization status of children enrolled at the school to the parent of each child enrolled at the school. (b) The notification: (1) must be provided not later than November 1; (2) must inform the parent of the number of students enrolled at the school who have not obtained the immunizations required for that school year by the Department of State Health Services under Section 38.001(b-1); and (3) may not provide information regarding the immunization status of specific students. (c) A public school is not required to provide the notification if each student at the school has obtained all immunizations required for that school year by the Department of State Health Services under Section 38.001(b-1). (d) The commissioner may adopt rules necessary to implement this section. SECTION 2. This Act applies beginning with the 2015-2016 school year. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2015.
