55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a requirement that public institutions of higher
88 education provide certain information to students and school
99 districts regarding student performance on Texas Success
1010 Initiative assessment instruments.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 51.3062, Education Code, is amended by
1313 adding Subsections (u) and (u-1) to read as follows:
1414 (u) An institution of higher education that administers an
1515 assessment instrument to students under this section shall:
1616 (1) provide to each assessed student an individual
1717 score report that includes information regarding each item answered
1818 incorrectly by the student; and
1919 (2) report to each school district from which assessed
2020 students graduated high school the following data on the district's
2121 students:
2222 (A) each student's scores on the assessment
2323 instrument; and
2424 (B) data on the students' overall performance on
2525 the assessment instrument disaggregated by:
2626 (i) content area for each subject tested;
2727 and
2828 (ii) student demographics, including
2929 campus, race, ethnicity, sex, age, and populations served by
3030 special programs, including special education, bilingual
3131 education, special language programs, gifted and talented
3232 programs, and compensatory education programs.
3333 (u-1) The board shall adopt rules as necessary to implement
3434 Subsection (u), including rules for implementing that subsection in
3535 a manner that complies with federal law regarding confidentiality
3636 of student medical or educational information, including the Health
3737 Insurance Portability and Accountability Act of 1996 (42 U.S.C.
3838 Section 1320d et seq.) and the Family Educational Rights and
3939 Privacy Act of 1974 (20 U.S.C. Section 1232g), and any state law
4040 relating to the privacy of student information.
4141 SECTION 2. Sections 51.3062(u) and (u-1), Education Code,
4242 as added by this Act, apply beginning with assessment instruments
4343 administered by public institutions of higher education to entering
4444 undergraduate students for the 2016 fall semester.
4545 SECTION 3. This Act takes effect September 1, 2015.
