|---|
| 9 | 9 | | districts regarding student performance on Texas Success |
|---|
| 10 | 10 | | Initiative assessment instruments. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 51.3062, Education Code, is amended by |
|---|
| 13 | 13 | | adding Subsections (u) and (u-1) to read as follows: |
|---|
| 14 | 14 | | (u) An institution of higher education that administers an |
|---|
| 15 | 15 | | assessment instrument to students under this section shall: |
|---|
| 16 | 16 | | (1) provide to each assessed student an individual |
|---|
| 17 | 17 | | score report that includes information regarding each item answered |
|---|
| 18 | 18 | | incorrectly by the student; and |
|---|
| 19 | 19 | | (2) report to each school district from which assessed |
|---|
| 20 | 20 | | students graduated high school the following data on the district's |
|---|
| 21 | 21 | | students: |
|---|
| 22 | 22 | | (A) each student's scores on the assessment |
|---|
| 23 | 23 | | instrument; and |
|---|
| 24 | 24 | | (B) data on the students' overall performance on |
|---|
| 25 | 25 | | the assessment instrument disaggregated by: |
|---|
| 26 | 26 | | (i) content area for each subject tested; |
|---|
| 27 | 27 | | and |
|---|
| 28 | 28 | | (ii) student demographics, including |
|---|
| 29 | 29 | | campus, race, ethnicity, sex, age, and populations served by |
|---|
| 30 | 30 | | special programs, including special education, bilingual |
|---|
| 31 | 31 | | education, special language programs, gifted and talented |
|---|
| 32 | 32 | | programs, and compensatory education programs. |
|---|
| 33 | 33 | | (u-1) The board shall adopt rules as necessary to implement |
|---|
| 34 | 34 | | Subsection (u), including rules for implementing that subsection in |
|---|
| 35 | 35 | | a manner that complies with federal law regarding confidentiality |
|---|
| 36 | 36 | | of student medical or educational information, including the Health |
|---|
| 37 | 37 | | Insurance Portability and Accountability Act of 1996 (42 U.S.C. |
|---|
| 38 | 38 | | Section 1320d et seq.) and the Family Educational Rights and |
|---|
| 39 | 39 | | Privacy Act of 1974 (20 U.S.C. Section 1232g), and any state law |
|---|
| 40 | 40 | | relating to the privacy of student information. |
|---|
| 41 | 41 | | SECTION 2. Sections 51.3062(u) and (u-1), Education Code, |
|---|
| 42 | 42 | | as added by this Act, apply beginning with assessment instruments |
|---|
| 43 | 43 | | administered by public institutions of higher education to entering |
|---|
| 44 | 44 | | undergraduate students for the 2016 fall semester. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2015. |
