9	7		AN ACT
10	8		relating to the reimbursement of providers for the provision of
11	9		certain home telemonitoring services under Medicaid.
12	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	11		SECTION 1. Section 531.02164, Government Code, is amended
14	12		by adding Subsection (c-1) to read as follows:
15	13		(c-1) Notwithstanding Subsection (c)(1), the program
16	14		required under this section must also provide that home
17	15		telemonitoring services are available to pediatric patients with
18	16		chronic or complex medical needs who:
19	17		(1) are being concurrently treated by at least three
20	18		medical specialists;
21	19		(2) are medically dependent on technology;
22	20		(3) are diagnosed with end-stage solid organ disease;
23	21		or
24	22		(4) require mechanical ventilation.
25	23		SECTION 2. Section 531.02176, Government Code, as amended
26	24		by S.B. 219, Acts of the 84th Legislature, Regular Session, 2015, is
27	25		repealed.
28	26		SECTION 3. The executive commissioner of the Health and
29	27		Human Services Commission shall adopt the rules necessary to
30	28		implement Section 531.02164(c-1), Government Code, as added by this
31	29		Act, not later than December 1, 2015.
32	30		SECTION 4. If before implementing any provision of this Act
33	31		a state agency determines that a waiver, an amendment to an existing
34	32		waiver, or another authorization from a federal agency is necessary
35	33		for implementation of that provision, the agency affected by the
36	34		provision shall request the waiver, amendment to the existing
37	35		waiver, or other authorization and may delay implementing that
38	36		provision until the waiver, amendment, or authorization is granted.
39	37		SECTION 5. This Act takes effect September 1, 2015.
