114 AN ACT
125 relating to the determination of an experience-rated employer's
136 eligibility for a surplus credit rate under the Texas Unemployment
147 Compensation Act.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Section 204.0652(d), Labor Code, is amended to
1710 read as follows:
1811 (d) An employer may not receive a surplus credit rate if any
1912 delinquent contributions are due on the computation [contribution]
2013 date, but is eligible for a surplus credit rate beginning on the
2114 calendar quarter following the quarter in which the delinquent
2215 contributions are paid.
2316 SECTION 2. This Act takes effect immediately if it receives
2417 a vote of two-thirds of all the members elected to each house, as
2518 provided by Section 39, Article III, Texas Constitution. If this
2619 Act does not receive the vote necessary for immediate effect, this
2720 Act takes effect September 1, 2015.
