| 24 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 25 | 8 | | SECTION 1. Section 406.001, Government Code, is amended to |
|---|
| 26 | 9 | | read as follows: |
|---|
| 27 | 10 | | Sec. 406.001. APPOINTMENTS. (a) The secretary of state may |
|---|
| 28 | 11 | | appoint a notary public at any time. |
|---|
| 29 | 12 | | (b) The secretary of state shall assign each notary public |
|---|
| 30 | 13 | | an identifying number and keep a record of the number assigned to |
|---|
| 31 | 14 | | each notary public. |
|---|
| 32 | 15 | | SECTION 2. Section 406.008(b), Government Code, is amended |
|---|
| 33 | 16 | | to read as follows: |
|---|
| 34 | 17 | | (b) When the commission is issued, the secretary of state |
|---|
| 35 | 18 | | shall supply the notary public with: |
|---|
| 36 | 19 | | (1) materials outlining the powers and duties of the |
|---|
| 37 | 20 | | office; |
|---|
| 38 | 21 | | (2) a list of prohibited acts; [and] |
|---|
| 39 | 22 | | (3) sample forms for an acknowledgment, jurat, and |
|---|
| 40 | 23 | | verification and for the administering of an oath, protest, and |
|---|
| 41 | 24 | | deposition; and |
|---|
| 42 | 25 | | (4) the identifying number assigned to the notary |
|---|
| 43 | 26 | | public. |
|---|
| 44 | 27 | | SECTION 3. Section 406.013(a), Government Code, is amended |
|---|
| 45 | 28 | | to read as follows: |
|---|
| 46 | 29 | | (a) A notary public shall provide a seal of office that |
|---|
| 47 | 30 | | clearly shows, when embossed, stamped, or printed on a document, |
|---|
| 48 | 31 | | the words "Notary Public, State of Texas" around a star of five |
|---|
| 49 | 32 | | points, the notary public's name, the notary public's identifying |
|---|
| 50 | 33 | | number, and the date the notary public's commission expires. The |
|---|
| 51 | 34 | | notary public shall authenticate all official acts with the seal of |
|---|
| 52 | 35 | | office. |
|---|
| 53 | 36 | | SECTION 4. Notwithstanding the requirements of this Act |
|---|
| 54 | 37 | | that the secretary of state issue an identifying number to each |
|---|
| 55 | 38 | | notary public, the secretary of state is required to issue an |
|---|
| 56 | 39 | | identifying number only to a notary public who applies for a |
|---|
| 57 | 40 | | commission or a reappointment on or after the effective date of this |
|---|
| 58 | 41 | | Act. |
|---|
| 59 | 42 | | SECTION 5. This Act takes effect January 1, 2016. |
