66 AN ACT
77 relating to the satisfaction of a condition of community
88 supervision requiring performance of community service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 16(f), Article 42.12, Code of Criminal
1111 Procedure, is amended to read as follows:
1212 (f) In lieu of requiring a defendant to work a specified
1313 number of hours at a community service project or projects under
1414 Subsection (a), the judge may order a defendant to make a specified
1515 donation to:
1616 (1) a nonprofit food bank or food pantry in the
1717 community in which the defendant resides; or
1818 (2) another nonprofit organization that:
1919 (A) is exempt from taxation under Section 501(a)
2020 of the Internal Revenue Code of 1986 because it is listed in Section
2121 501(c)(3) of that code; and
2222 (B) provides services or assistance to needy
2323 individuals and families in the community in which the defendant
2424 resides.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2015.
