9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 707, Transportation Code, is amended by | |
11 | 11 | adding Section 707.0022 to read as follows: | |
12 | 12 | Sec. 707.0022. ELECTION TO REPEAL ORDINANCE. (a) The | |
13 | 13 | governing body of a local authority shall submit to the voters of | |
14 | 14 | the local authority the question of repealing an ordinance adopted | |
15 | 15 | under Section 707.002 if the governing body receives a petition | |
16 | 16 | that requests the election and is signed by 10 percent of the | |
17 | 17 | registered voters of the local authority. | |
18 | 18 | (b) If a majority of the votes cast at the election favor the | |
19 | 19 | repeal of the ordinance, the governing body: | |
20 | 20 | (1) shall repeal the ordinance; and | |
21 | 21 | (2) may not subsequently adopt an ordinance under | |
22 | 22 | Section 707.002. | |
23 | 23 | (c) An election on the question of repealing an ordinance | |
24 | 24 | under Section 707.002 may not be held more often than every two | |
25 | 25 | years. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2015. |
