66 AN ACT
77 relating to an election to repeal a photographic traffic signal
88 enforcement system ordinance.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 707, Transportation Code, is amended by
1111 adding Section 707.0022 to read as follows:
1212 Sec. 707.0022. ELECTION TO REPEAL ORDINANCE. (a) The
1313 governing body of a local authority shall submit to the voters of
1414 the local authority the question of repealing an ordinance adopted
1515 under Section 707.002 if the governing body receives a petition
1616 that requests the election and is signed by 10 percent of the
1717 registered voters of the local authority.
1818 (b) If a majority of the votes cast at the election favor the
1919 repeal of the ordinance, the governing body:
2020 (1) shall repeal the ordinance; and
2121 (2) may not subsequently adopt an ordinance under
2222 Section 707.002.
2323 (c) An election on the question of repealing an ordinance
2424 under Section 707.002 may not be held more often than every two
2525 years.
2626 SECTION 2. This Act takes effect September 1, 2015.
