104 AN ACT
115 relating to the composition of local boards of the Texas Emergency
126 Services Retirement System.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 865.012, Government Code, is amended by
159 amending Subsection (a) and adding Subsection (a-1) to read as
1610 follows:
1711 (a) A local board is composed of:
1812 (1) one trustee selected by the governing body of the
1913 political subdivision of which a participating department is a
2014 part;
2115 (2) except as provided by Subsection (a-1), three
2216 trustees who are active members representing a participating
2317 department chosen by a majority of the emergency services personnel
2418 in the department who are eligible to participate in the pension
2519 system; and
2620 (3) two trustees who are representatives of the
2721 political subdivision who are chosen by the other members of the
2822 local board.
2923 (a-1) If a participating department does not have a
3024 sufficient number of active members to serve on a local board under
3125 Subsection (a)(2), the other members of the local board, or if there
3226 are no other members of the local board, the governing body of the
3327 political subdivision of which the department is a part shall
3428 select one or more trustees to serve under that subdivision. A
3529 person selected under this subsection to serve as a trustee must be:
3630 (1) a retiree of the pension system; or
3731 (2) a beneficiary of the pension system who is the
3832 surviving spouse of a former member or retiree.
3933 SECTION 2. This Act takes effect immediately if it receives
4034 a vote of two-thirds of all the members elected to each house, as
4135 provided by Section 39, Article III, Texas Constitution. If this
4236 Act does not receive the vote necessary for immediate effect, this
4337 Act takes effect September 1, 2015.
