| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 865.012, Government Code, is amended by |
|---|
| 15 | 9 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 16 | 10 | | follows: |
|---|
| 17 | 11 | | (a) A local board is composed of: |
|---|
| 18 | 12 | | (1) one trustee selected by the governing body of the |
|---|
| 19 | 13 | | political subdivision of which a participating department is a |
|---|
| 20 | 14 | | part; |
|---|
| 21 | 15 | | (2) except as provided by Subsection (a-1), three |
|---|
| 22 | 16 | | trustees who are active members representing a participating |
|---|
| 23 | 17 | | department chosen by a majority of the emergency services personnel |
|---|
| 24 | 18 | | in the department who are eligible to participate in the pension |
|---|
| 25 | 19 | | system; and |
|---|
| 26 | 20 | | (3) two trustees who are representatives of the |
|---|
| 27 | 21 | | political subdivision who are chosen by the other members of the |
|---|
| 28 | 22 | | local board. |
|---|
| 29 | 23 | | (a-1) If a participating department does not have a |
|---|
| 30 | 24 | | sufficient number of active members to serve on a local board under |
|---|
| 31 | 25 | | Subsection (a)(2), the other members of the local board, or if there |
|---|
| 32 | 26 | | are no other members of the local board, the governing body of the |
|---|
| 33 | 27 | | political subdivision of which the department is a part shall |
|---|
| 34 | 28 | | select one or more trustees to serve under that subdivision. A |
|---|
| 35 | 29 | | person selected under this subsection to serve as a trustee must be: |
|---|
| 36 | 30 | | (1) a retiree of the pension system; or |
|---|
| 37 | 31 | | (2) a beneficiary of the pension system who is the |
|---|
| 38 | 32 | | surviving spouse of a former member or retiree. |
|---|
| 39 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 40 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 37 | | Act takes effect September 1, 2015. |
