85 AN ACT
96 relating to the use of a credit or charge card by certain state
107 agencies to make certain purchases.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 403.023, Government Code, is amended by
9+ SECTION 1. Subchapter A, Chapter 402, Government Code, is
10+ amended by adding Section 402.011 to read as follows:
11+ Sec. 402.011. PAYMENT FOR TRAVEL SERVICES WITH CREDIT OR
12+ CHARGE CARD. The attorney general by rule shall develop and
13+ implement a policy that encourages participation in a program
14+ administered by the comptroller relating to the use of a credit or
15+ charge card to pay for travel expenses.
16+ SECTION 2. Section 403.023, Government Code, is amended by
1317 adding Subsections (b-1) and (b-2) to read as follows:
1418 (b-1) Except as provided by Subsection (b-2), if the
1519 comptroller adopts rules authorized under Subsection (b), the rules
1620 must:
1721 (1) require a state agency in the executive branch of
1822 state government to use a credit or charge card to pay for all
1923 purchases unless the comptroller determines that another method of
2024 payment is more advantageous to the state; and
2125 (2) prohibit an employee of a state agency in the
2226 executive branch of state government from using a personal credit
2327 or charge card to pay for the state agency's purchases.
2428 (b-2) Subsection (b-1) does not apply to:
2529 (1) an institution of higher education as defined by
2630 Section 61.003, Education Code;
2731 (2) the Health and Human Services Commission;
2832 (3) a health and human services agency as defined by
29- Section 531.001; or
30- (4) the office of the governor.
31- SECTION 2. Subchapter A, Chapter 531, Government Code, is

3439 CHARGE CARD. The executive commissioner by rule shall develop, and
3540 the commission and each health and human services agency shall
3641 implement, a policy that encourages participation in a program
3742 administered by the comptroller relating to the use of a credit or
3843 charge card to pay for travel expenses.

4651 agency in the executive branch of state government participates in
4752 a program administered by the comptroller that allows the agency to
4853 use a credit or charge card to pay for travel expenses:
4954 (1) the agency shall use the credit or charge card to
5055 pay for travel expenses required for agency travel, unless the
5156 comptroller determines that another method of payment is more
5257 advantageous to the state; and
5358 (2) an employee of the agency may not use the
5459 employee's personal credit or charge card to pay for travel
5560 expenses required for agency travel.
5661 (c) Subsection (b) does not apply to:
5762 (1) an institution of higher education as defined by
5863 Section 61.003, Education Code;
5964 (2) the Health and Human Services Commission;
6065 (3) a health and human services agency as defined by
61- Section 531.001; or
62- (4) the office of the governor.
63- SECTION 4. Subchapter B, Chapter 2171, Government Code, is

6571 Sec. 2171.0521. PAYMENT FOR TRAVEL SERVICES WITH CREDIT OR
6672 CHARGE CARD. (a) Except as provided by Subsection (b), if a state
6773 agency in the executive branch of state government participates in
6874 a program administered by the comptroller that allows the agency to
6975 use a credit or charge card to purchase travel services:
7076 (1) the agency shall use the credit or charge card to
7177 purchase travel services required for agency travel, unless the
7278 comptroller determines that another method of purchase is more
7379 advantageous to the state; and
7480 (2) an employee of the agency may not use the
7581 employee's personal credit or charge card to purchase travel
7682 services required for agency travel.
7783 (b) This section does not apply to:
7884 (1) an institution of higher education as defined by
7985 Section 61.003, Education Code;
8086 (2) the Health and Human Services Commission;
8187 (3) a health and human services agency as defined by
82- Section 531.001; or
83- (4) the office of the governor.
84- SECTION 5. This Act takes effect immediately if it receives
88+ Section 531.001;
89+ (4) the office of the attorney general; or
90+ (5) the office of the governor.
91+ SECTION 6. This Act takes effect immediately if it receives
8592 a vote of two-thirds of all the members elected to each house, as
8693 provided by Section 39, Article III, Texas Constitution. If this
8794 Act does not receive the vote necessary for immediate effect, this
8895 Act takes effect September 1, 2015.
