8	5		AN ACT
9	6		relating to the use of a credit or charge card by certain state
10	7		agencies to make certain purchases.
11	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12		-	SECTION 1. Section 403.023, Government Code, is amended by
	9	+	SECTION 1. Subchapter A, Chapter 402, Government Code, is
	10	+	amended by adding Section 402.011 to read as follows:
	11	+	Sec. 402.011. PAYMENT FOR TRAVEL SERVICES WITH CREDIT OR
	12	+	CHARGE CARD. The attorney general by rule shall develop and
	13	+	implement a policy that encourages participation in a program
	14	+	administered by the comptroller relating to the use of a credit or
	15	+	charge card to pay for travel expenses.
	16	+	SECTION 2. Section 403.023, Government Code, is amended by
13	17		adding Subsections (b-1) and (b-2) to read as follows:
14	18		(b-1) Except as provided by Subsection (b-2), if the
15	19		comptroller adopts rules authorized under Subsection (b), the rules
16	20		must:
17	21		(1) require a state agency in the executive branch of
18	22		state government to use a credit or charge card to pay for all
19	23		purchases unless the comptroller determines that another method of
20	24		payment is more advantageous to the state; and
21	25		(2) prohibit an employee of a state agency in the
22	26		executive branch of state government from using a personal credit
23	27		or charge card to pay for the state agency's purchases.
24	28		(b-2) Subsection (b-1) does not apply to:
25	29		(1) an institution of higher education as defined by
26	30		Section 61.003, Education Code;
27	31		(2) the Health and Human Services Commission;
28	32		(3) a health and human services agency as defined by
29		-	Section 531.001; or
30		-	(4) the office of the governor.

	36	+	SECTION 3. Subchapter A, Chapter 531, Government Code, is
32	37		amended by adding Section 531.0175 to read as follows:
33	38		Sec. 531.0175. PAYMENT FOR TRAVEL SERVICES WITH CREDIT OR
34	39		CHARGE CARD. The executive commissioner by rule shall develop, and
35	40		the commission and each health and human services agency shall
36	41		implement, a policy that encourages participation in a program
37	42		administered by the comptroller relating to the use of a credit or
38	43		charge card to pay for travel expenses.
39		-	SECTION 3. Section 660.021, Government Code, is amended to

41	46		Sec. 660.021. RULES. (a) The comptroller shall adopt rules
42	47		for the effective and efficient administration of this chapter and
43	48		the travel provisions of the General Appropriations Act.
44	49		(b) Except as provided by Subsection (c), the rules adopted
45	50		by the comptroller under this section must require that if a state
46	51		agency in the executive branch of state government participates in
47	52		a program administered by the comptroller that allows the agency to
48	53		use a credit or charge card to pay for travel expenses:
49	54		(1) the agency shall use the credit or charge card to
50	55		pay for travel expenses required for agency travel, unless the
51	56		comptroller determines that another method of payment is more
52	57		advantageous to the state; and
53	58		(2) an employee of the agency may not use the
54	59		employee's personal credit or charge card to pay for travel
55	60		expenses required for agency travel.
56	61		(c) Subsection (b) does not apply to:
57	62		(1) an institution of higher education as defined by
58	63		Section 61.003, Education Code;
59	64		(2) the Health and Human Services Commission;
60	65		(3) a health and human services agency as defined by
61		-	Section 531.001; or
62		-	(4) the office of the governor.
63		-	SECTION 4. Subchapter B, Chapter 2171, Government Code, is

	68	+	(5) the office of the governor.
	69	+	SECTION 5. Subchapter B, Chapter 2171, Government Code, is
64	70		amended by adding Section 2171.0521 to read as follows:
65	71		Sec. 2171.0521. PAYMENT FOR TRAVEL SERVICES WITH CREDIT OR
66	72		CHARGE CARD. (a) Except as provided by Subsection (b), if a state
67	73		agency in the executive branch of state government participates in
68	74		a program administered by the comptroller that allows the agency to
69	75		use a credit or charge card to purchase travel services:
70	76		(1) the agency shall use the credit or charge card to
71	77		purchase travel services required for agency travel, unless the
72	78		comptroller determines that another method of purchase is more
73	79		advantageous to the state; and
74	80		(2) an employee of the agency may not use the
75	81		employee's personal credit or charge card to purchase travel
76	82		services required for agency travel.
77	83		(b) This section does not apply to:
78	84		(1) an institution of higher education as defined by
79	85		Section 61.003, Education Code;
80	86		(2) the Health and Human Services Commission;
81	87		(3) a health and human services agency as defined by
82		-	Section 531.001; or
83		-	(4) the office of the governor.
84		-	SECTION 5. This Act takes effect immediately if it receives
	88	+	Section 531.001;
	89	+	(4) the office of the attorney general; or
	90	+	(5) the office of the governor.
	91	+	SECTION 6. This Act takes effect immediately if it receives
85	92		a vote of two-thirds of all the members elected to each house, as
86	93		provided by Section 39, Article III, Texas Constitution. If this
87	94		Act does not receive the vote necessary for immediate effect, this
88	95		Act takes effect September 1, 2015.
