9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 438, Health and Safety Code, is amended |
---|
11 | 11 | | by adding Subchapter E to read as follows: |
---|
12 | 12 | | SUBCHAPTER E. CARDIOPULMONARY RESUSCITATION CERTIFICATION FOR |
---|
13 | 13 | | CERTAIN FOOD SERVICE EMPLOYEES |
---|
14 | 14 | | Sec. 438.051. APPLICABILITY. This subchapter applies only |
---|
15 | 15 | | to a food service establishment at which space for eating is |
---|
16 | 16 | | designed or designated. |
---|
17 | 17 | | Sec. 438.052. CARDIOPULMONARY RESUSCITATION CERTIFICATION |
---|
18 | 18 | | REQUIRED. (a) A food service establishment described by Section |
---|
19 | 19 | | 438.051 shall ensure that all employees of the establishment are |
---|
20 | 20 | | certified in cardiopulmonary resuscitation. |
---|
21 | 21 | | (b) A food service establishment shall: |
---|
22 | 22 | | (1) provide training for all employees in |
---|
23 | 23 | | cardiopulmonary resuscitation as often as necessary to maintain |
---|
24 | 24 | | employee certification; and |
---|
25 | 25 | | (2) pay employees their regular wage for time spent in |
---|
26 | 26 | | the training. |
---|
27 | 27 | | (c) The instructor of a training course required under this |
---|
28 | 28 | | section must be authorized to provide the instruction by the |
---|
29 | 29 | | American Heart Association, the American Red Cross, or a similar |
---|
30 | 30 | | nationally recognized association. |
---|
31 | 31 | | (d) A food service establishment that hires an employee who |
---|
32 | 32 | | is not certified in cardiopulmonary resuscitation shall provide |
---|
33 | 33 | | training for that employee not later than the 30th day after the |
---|
34 | 34 | | date of hire. |
---|
35 | 35 | | (e) A food service establishment may not discriminate in |
---|
36 | 36 | | hiring based on whether an applicant is certified in |
---|
37 | 37 | | cardiopulmonary resuscitation. |
---|
38 | 38 | | SECTION 2. (a) The change in law made by this Act by adding |
---|
39 | 39 | | Subchapter E, Chapter 438, Health and Safety Code, applies to an |
---|
40 | 40 | | employee who is hired on or after the effective date of this Act. |
---|
41 | 41 | | (b) A food service establishment shall provide the training |
---|
42 | 42 | | required by this Act for employees hired before the effective date |
---|
43 | 43 | | of this Act not later than October 1, 2015. |
---|
44 | 44 | | SECTION 3. This Act takes effect September 1, 2015. |
