77 relating to cardiopulmonary resuscitation certification
88 requirements for certain food service workers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 438, Health and Safety Code, is amended
1111 by adding Subchapter E to read as follows:
1212 SUBCHAPTER E. CARDIOPULMONARY RESUSCITATION CERTIFICATION FOR
1313 CERTAIN FOOD SERVICE EMPLOYEES
1414 Sec. 438.051. APPLICABILITY. This subchapter applies only
1515 to a food service establishment at which space for eating is
1616 designed or designated.
1717 Sec. 438.052. CARDIOPULMONARY RESUSCITATION CERTIFICATION
1818 REQUIRED. (a) A food service establishment described by Section
1919 438.051 shall ensure that all employees of the establishment are
2020 certified in cardiopulmonary resuscitation.
2121 (b) A food service establishment shall:
2222 (1) provide training for all employees in
2323 cardiopulmonary resuscitation as often as necessary to maintain
2424 employee certification; and
2525 (2) pay employees their regular wage for time spent in
2626 the training.
2727 (c) The instructor of a training course required under this
2828 section must be authorized to provide the instruction by the
2929 American Heart Association, the American Red Cross, or a similar
3030 nationally recognized association.
3131 (d) A food service establishment that hires an employee who
3232 is not certified in cardiopulmonary resuscitation shall provide
3333 training for that employee not later than the 30th day after the
3434 date of hire.
3535 (e) A food service establishment may not discriminate in
3636 hiring based on whether an applicant is certified in
3737 cardiopulmonary resuscitation.
3838 SECTION 2. (a) The change in law made by this Act by adding
3939 Subchapter E, Chapter 438, Health and Safety Code, applies to an
4040 employee who is hired on or after the effective date of this Act.
4141 (b) A food service establishment shall provide the training
4242 required by this Act for employees hired before the effective date
4343 of this Act not later than October 1, 2015.
4444 SECTION 3. This Act takes effect September 1, 2015.
