| 7 | 7 | | relating to the creation of a grant program to provide money for |
|---|
| 8 | 8 | | security at certain major events; authorizing fees. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 1507 (S.B. 456), Acts of the 76th |
|---|
| 11 | 11 | | Legislature, Regular Session, 1999 (Article 5190.14, Vernon's |
|---|
| 12 | 12 | | Texas Civil Statutes), is amended by adding Section 5D to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | Sec. 5D. MAJOR EVENTS SECURITY GRANT PROGRAM. (a) In this |
|---|
| 15 | 15 | | section, "event" means an event or a related series of events held |
|---|
| 16 | 16 | | in this state. The term includes any activity related to or |
|---|
| 17 | 17 | | associated with the event. |
|---|
| 18 | 18 | | (b) In administering this section, the department may: |
|---|
| 19 | 19 | | (1) enter into and enforce contracts with a county or a |
|---|
| 20 | 20 | | municipality and execute and deliver other instruments necessary to |
|---|
| 21 | 21 | | make and administer grants awarded under this section; |
|---|
| 22 | 22 | | (2) impose and collect reasonable fees and charges in |
|---|
| 23 | 23 | | connection with grants made under this section and provide |
|---|
| 24 | 24 | | reasonable penalties for delinquent payment of fees or charges; and |
|---|
| 25 | 25 | | (3) adopt rules necessary to implement the program. |
|---|
| 26 | 26 | | (c) The department may only use money expressly |
|---|
| 27 | 27 | | appropriated by the legislature to the department for the grant |
|---|
| 28 | 28 | | program established by this section and may only use that money to |
|---|
| 29 | 29 | | make grants authorized by this section for a purpose specified in |
|---|
| 30 | 30 | | Subsection (e)(3) of this section. |
|---|
| 31 | 31 | | (d) A county or municipality that contains a site at which |
|---|
| 32 | 32 | | an eligible event is or may be hosted may apply for and receive a |
|---|
| 33 | 33 | | grant under this section. A grant recipient may use the money |
|---|
| 34 | 34 | | provided through a grant under this section only for providing |
|---|
| 35 | 35 | | security at the event for which the grant is awarded. |

| 36 | 36 | | (e) To be eligible to receive a grant under this section, an |
|---|
| 37 | 37 | | event for which a county or municipality is applying must: |
|---|
| 38 | 38 | | (1) be held annually; |
|---|
| 39 | 39 | | (2) have had a total economic impact on the local |
|---|
| 40 | 40 | | economy where the event was previously held of more than $300 |
|---|
| 41 | 41 | | million in the immediately preceding year; and |
|---|
| 42 | 42 | | (3) serve a state purpose or a public purpose of the |
|---|
| 43 | 43 | | development and diversification of the economy of this state, the |
|---|
| 44 | 44 | | elimination of unemployment or underemployment in this state, or |
|---|
| 45 | 45 | | the development or expansion of commerce in this state. |
|---|
| 46 | 46 | | (f) The department by rule shall establish an application |
|---|
| 47 | 47 | | process, award process, and eligibility criteria for receiving a |
|---|
| 48 | 48 | | grant under this section. The department shall also establish |
|---|
| 49 | 49 | | criteria for prioritizing applicants for grants under this section |
|---|
| 50 | 50 | | and reporting requirements for grants awarded under this section. |
|---|
| 51 | 51 | | (g) The department shall compile an annual report |
|---|
| 52 | 52 | | identifying the recipient of each grant awarded under this section |
|---|
| 53 | 53 | | each state fiscal year, the amount awarded for each grant, and the |
|---|
| 54 | 54 | | expenses paid through the grant. Each county or municipality that |
|---|
| 55 | 55 | | receives a grant under this section must submit to the department |
|---|
| 56 | 56 | | any information the department requires to compile the report |
|---|
| 57 | 57 | | required under this subsection. |
|---|
| 58 | 58 | | (h) A county or municipality that does not spend grant money |
|---|
| 59 | 59 | | received under this section for security purposes as required by |
|---|
| 60 | 60 | | this section must repay the amount of the grant that was in |
|---|
| 61 | 61 | | noncompliance. |
|---|
| 62 | 62 | | SECTION 2. Not later than January 1, 2016, the Economic |
|---|
| 63 | 63 | | Development and Tourism Division of the governor's office shall |
|---|
| 64 | 64 | | adopt the rules and eligibility standards required by Section 5D, |
|---|
| 65 | 65 | | Chapter 1507 (S.B. 456), Acts of the 76th Legislature, Regular |
|---|
| 66 | 66 | | Session, 1999 (Article 5190.14, Vernon's Texas Civil Statutes), as |
|---|
| 67 | 67 | | added by this Act. |
|---|
| 68 | 68 | | SECTION 3. This Act does not make an appropriation. A |
|---|
| 69 | 69 | | provision in this Act that creates a new governmental program, |
|---|
| 70 | 70 | | creates a new entitlement, or imposes a new duty on a governmental |
|---|
| 71 | 71 | | entity is not mandatory during a fiscal period for which the |
|---|
| 72 | 72 | | legislature has not made a specific appropriation to implement the |
|---|
| 73 | 73 | | provision. |
|---|
| 74 | 74 | | SECTION 4. This Act takes effect September 1, 2015. |
