114 AN ACT
125 relating to the composition, duties, and continuation of the human
136 trafficking prevention task force.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Sections 402.035(c), (d), and (h), Government
169 Code, are amended to read as follows:
1710 (c) The task force is composed of the following:
1811 (1) the governor or the governor's designee;
1912 (2) the attorney general or the attorney general's
2013 designee;
2114 (3) the executive commissioner of the Health and Human
2215 Services Commission or the executive commissioner's designee;
2316 (4) the commissioner of the Department of Family and
2417 Protective Services or the commissioner's designee;
2518 (5) the commissioner of the Department of State Health
2619 Services or the commissioner's designee;
2720 (6) the public safety director of the Department of
2821 Public Safety or the director's designee;
2922 (7) one representative from each of the following
3023 state agencies, appointed by the chief administrative officer of
3124 the respective agency:
3225 (A) the Texas Workforce Commission;
3326 (B) the Texas Department of Criminal Justice;
3427 (C) the Texas Juvenile Justice Department [Youth
3528 Commission;
3629 [(D) the Texas Juvenile Probation Commission];
3730 and
3831 (D) [(E)] the Texas Alcoholic Beverage
3932 Commission; and
4033 (8) as appointed by the attorney general:
4134 (A) a chief public defender employed by a public
4235 defender's office, as defined by Article 26.044(a), Code of
4336 Criminal Procedure, or an attorney designated by the chief public
4437 defender;
4538 (B) an attorney representing the state;
4639 (C) a representative of:
4740 (i) a hotel and motel association;
4841 (ii) a district and county attorneys
4942 association; [and]
5043 (iii) a state police association; and
5144 (iv) a statewide medical association;
5245 (D) representatives of sheriff's departments;
5346 (E) representatives of local law enforcement
5447 agencies affected by human trafficking; and
5548 (F) representatives of nongovernmental entities
5649 making comprehensive efforts to combat human trafficking by:
5750 (i) identifying human trafficking victims;
5851 (ii) providing legal or other services to
5952 human trafficking victims;
6053 (iii) participating in community outreach
6154 or public awareness efforts regarding human trafficking;
6255 (iv) providing or developing training
6356 regarding the prevention of human trafficking; or
6457 (v) engaging in other activities designed
6558 to prevent human trafficking.
6659 (d) The task force shall:
6760 (1) collaborate, as needed to fulfill the duties of
6861 the task force, with:
6962 (A) United States attorneys for the districts of
7063 Texas; and
7164 (B) special agents or customs and border
7265 protection officers and border patrol agents of:
7366 (i) the Federal Bureau of Investigation;
7467 (ii) the United States Drug Enforcement
7568 Administration;
7669 (iii) the Bureau of Alcohol, Tobacco,
7770 Firearms and Explosives;
7871 (iv) United States Immigration and Customs
7972 Enforcement; or
8073 (v) the United States Department of
8174 Homeland Security;
8275 (2) collect, organize, and periodically publish
8376 statistical data on the nature and extent of human trafficking in
8477 this state, including data described by Subdivisions (4)(A), (B),
8578 (C), (D), and (E);
8679 (3) solicit cooperation and assistance from state and
8780 local governmental agencies, political subdivisions of the state,
8881 nongovernmental organizations, and other persons, as appropriate,
8982 for the purpose of collecting and organizing statistical data under
9083 Subdivision (2);
9184 (4) ensure that each state or local governmental
9285 agency and political subdivision of the state and each state or
9386 local law enforcement agency, district attorney, or county attorney
9487 that assists in the prevention of human trafficking collects
9588 statistical data related to human trafficking, including, as
9689 appropriate:
9790 (A) the number of investigations concerning,
9891 arrests and prosecutions for, and convictions of:
9992 (i) the offense of trafficking of persons;
10093 [and]
10194 (ii) the offense of forgery or an offense
10295 under Chapter 43, Penal Code, if the offense was committed as part
10396 of a criminal episode involving the trafficking of persons; and
10497 (iii) an offense punishable under Section
10598 43.02(c)(3), Penal Code, regardless of whether the offense was
10699 committed as part of a criminal episode involving the trafficking
107100 of persons;
108101 (B) demographic information on persons who are
109102 convicted of offenses described by Paragraph (A) and persons who
110103 are the victims of those offenses;
111104 (C) geographic routes by which human trafficking
112105 victims are trafficked, including routes by which victims are
113106 trafficked across this state's international border, and
114107 geographic patterns in human trafficking, including the country or
115108 state of origin and the country or state of destination;
116109 (D) means of transportation and methods used by
117110 persons who engage in trafficking to transport their victims; and
118111 (E) social and economic factors that create a
119112 demand for the labor or services that victims of human trafficking
120113 are forced to provide;
121114 (5) work with the Texas Commission on Law Enforcement
122115 [Officer Standards and Education] to develop and conduct training
123116 for law enforcement personnel, victim service providers, and
124117 medical service providers to identify victims of human trafficking;
125118 (6) work with the Texas Education Agency, the
126119 Department of Family and Protective Services, and the Health and
127120 Human Services Commission to:
128121 (A) develop a list of key indicators that a
129122 person is a victim of human trafficking;
130123 (B) develop a standardized curriculum for
131124 training doctors, nurses, emergency medical services personnel,
132125 teachers, school counselors, school administrators, and personnel
133126 from the Department of Family and Protective Services and the
134127 Health and Human Services Commission to identify and assist victims
135128 of human trafficking;
136129 (C) train doctors, nurses, emergency medical
137130 services personnel, teachers, school counselors, school
138131 administrators, and personnel from the Department of Family and
139132 Protective Services and the Health and Human Services Commission to
140133 identify and assist victims of human trafficking;
141134 (D) develop and conduct training for personnel
142135 from the Department of Family and Protective Services and the
143136 Health and Human Services Commission on methods for identifying
144137 children in foster care who may be at risk of becoming victims of
145138 human trafficking; and
146139 (E) develop a process for referring identified
147140 human trafficking victims and individuals at risk of becoming
148141 victims to appropriate entities for services;
149142 (7) on the request of a judge of a county court, county
150143 court at law, or district court or a county attorney, district
151144 attorney, or criminal district attorney, assist and train the judge
152145 or the judge's staff or the attorney or the attorney's staff in the
153146 recognition and prevention of human trafficking;
154147 (8) examine training protocols related to human
155148 trafficking issues, as developed and implemented by federal, state,
156149 and local law enforcement agencies;
157150 (9) collaborate with state and local governmental
158151 agencies, political subdivisions of the state, and nongovernmental
159152 organizations to implement a media awareness campaign in
160153 communities affected by human trafficking;
161154 (10) develop recommendations on how to strengthen
162155 state and local efforts to prevent human trafficking, protect and
163156 assist human trafficking victims, and prosecute human trafficking
164157 offenders; [and]
165158 (11) examine the extent to which human trafficking is
166159 associated with the operation of sexually oriented businesses, as
167160 defined by Section 243.002, Local Government Code, and the
168161 workplace or public health concerns that are created by the
169162 association of human trafficking and the operation of sexually
170163 oriented businesses; and
171164 (12) develop recommendations for addressing the
172165 demand for forced labor or services or sexual conduct involving
173166 victims of human trafficking, including recommendations for
174167 increased penalties for individuals who engage or attempt to engage
175168 in prostitution with victims younger than 18 years of age.
176169 (h) This section expires September 1, 2017 [2015].
177170 SECTION 2. This Act takes effect immediately if it receives
178171 a vote of two-thirds of all the members elected to each house, as
179172 provided by Section 39, Article III, Texas Constitution. If this
180173 Act does not receive the vote necessary for immediate effect, this
181174 Act takes effect September 1, 2015.
