14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 8 | | SECTION 1. Sections 402.035(c), (d), and (h), Government |
---|
16 | 9 | | Code, are amended to read as follows: |
---|
17 | 10 | | (c) The task force is composed of the following: |
---|
18 | 11 | | (1) the governor or the governor's designee; |
---|
19 | 12 | | (2) the attorney general or the attorney general's |
---|
20 | 13 | | designee; |
---|
21 | 14 | | (3) the executive commissioner of the Health and Human |
---|
22 | 15 | | Services Commission or the executive commissioner's designee; |
---|
23 | 16 | | (4) the commissioner of the Department of Family and |
---|
24 | 17 | | Protective Services or the commissioner's designee; |
---|
25 | 18 | | (5) the commissioner of the Department of State Health |
---|
26 | 19 | | Services or the commissioner's designee; |
---|
27 | 20 | | (6) the public safety director of the Department of |
---|
28 | 21 | | Public Safety or the director's designee; |
---|
29 | 22 | | (7) one representative from each of the following |
---|
30 | 23 | | state agencies, appointed by the chief administrative officer of |
---|
31 | 24 | | the respective agency: |
---|
32 | 25 | | (A) the Texas Workforce Commission; |
---|
33 | 26 | | (B) the Texas Department of Criminal Justice; |
---|
34 | 27 | | (C) the Texas Juvenile Justice Department [Youth |
---|
35 | 28 | | Commission; |
---|
36 | 29 | | [(D) the Texas Juvenile Probation Commission]; |
---|
37 | 30 | | and |
---|
38 | 31 | | (D) [(E)] the Texas Alcoholic Beverage |
---|
39 | 32 | | Commission; and |
---|
40 | 33 | | (8) as appointed by the attorney general: |
---|
41 | 34 | | (A) a chief public defender employed by a public |
---|
42 | 35 | | defender's office, as defined by Article 26.044(a), Code of |
---|
43 | 36 | | Criminal Procedure, or an attorney designated by the chief public |
---|
44 | 37 | | defender; |
---|
45 | 38 | | (B) an attorney representing the state; |
---|
46 | 39 | | (C) a representative of: |
---|
47 | 40 | | (i) a hotel and motel association; |
---|
48 | 41 | | (ii) a district and county attorneys |
---|
49 | 42 | | association; [and] |
---|
50 | 43 | | (iii) a state police association; and |
---|
51 | 44 | | (iv) a statewide medical association; |
---|
52 | 45 | | (D) representatives of sheriff's departments; |
---|
53 | 46 | | (E) representatives of local law enforcement |
---|
54 | 47 | | agencies affected by human trafficking; and |
---|
55 | 48 | | (F) representatives of nongovernmental entities |
---|
56 | 49 | | making comprehensive efforts to combat human trafficking by: |
---|
57 | 50 | | (i) identifying human trafficking victims; |
---|
58 | 51 | | (ii) providing legal or other services to |
---|
59 | 52 | | human trafficking victims; |
---|
60 | 53 | | (iii) participating in community outreach |
---|
61 | 54 | | or public awareness efforts regarding human trafficking; |
---|
62 | 55 | | (iv) providing or developing training |
---|
63 | 56 | | regarding the prevention of human trafficking; or |
---|
64 | 57 | | (v) engaging in other activities designed |
---|
65 | 58 | | to prevent human trafficking. |
---|
66 | 59 | | (d) The task force shall: |
---|
67 | 60 | | (1) collaborate, as needed to fulfill the duties of |
---|
68 | 61 | | the task force, with: |
---|
69 | 62 | | (A) United States attorneys for the districts of |
---|
70 | 63 | | Texas; and |
---|
71 | 64 | | (B) special agents or customs and border |
---|
72 | 65 | | protection officers and border patrol agents of: |
---|
73 | 66 | | (i) the Federal Bureau of Investigation; |
---|
74 | 67 | | (ii) the United States Drug Enforcement |
---|
75 | 68 | | Administration; |
---|
76 | 69 | | (iii) the Bureau of Alcohol, Tobacco, |
---|
77 | 70 | | Firearms and Explosives; |
---|
78 | 71 | | (iv) United States Immigration and Customs |
---|
79 | 72 | | Enforcement; or |
---|
80 | 73 | | (v) the United States Department of |
---|
81 | 74 | | Homeland Security; |
---|
82 | 75 | | (2) collect, organize, and periodically publish |
---|
83 | 76 | | statistical data on the nature and extent of human trafficking in |
---|
84 | 77 | | this state, including data described by Subdivisions (4)(A), (B), |
---|
85 | 78 | | (C), (D), and (E); |
---|
86 | 79 | | (3) solicit cooperation and assistance from state and |
---|
87 | 80 | | local governmental agencies, political subdivisions of the state, |
---|
88 | 81 | | nongovernmental organizations, and other persons, as appropriate, |
---|
89 | 82 | | for the purpose of collecting and organizing statistical data under |
---|
90 | 83 | | Subdivision (2); |
---|
91 | 84 | | (4) ensure that each state or local governmental |
---|
92 | 85 | | agency and political subdivision of the state and each state or |
---|
93 | 86 | | local law enforcement agency, district attorney, or county attorney |
---|
94 | 87 | | that assists in the prevention of human trafficking collects |
---|
95 | 88 | | statistical data related to human trafficking, including, as |
---|
96 | 89 | | appropriate: |
---|
97 | 90 | | (A) the number of investigations concerning, |
---|
98 | 91 | | arrests and prosecutions for, and convictions of: |
---|
99 | 92 | | (i) the offense of trafficking of persons; |
---|
100 | 93 | | [and] |
---|
101 | 94 | | (ii) the offense of forgery or an offense |
---|
102 | 95 | | under Chapter 43, Penal Code, if the offense was committed as part |
---|
103 | 96 | | of a criminal episode involving the trafficking of persons; and |
---|
104 | 97 | | (iii) an offense punishable under Section |
---|
105 | 98 | | 43.02(c)(3), Penal Code, regardless of whether the offense was |
---|
106 | 99 | | committed as part of a criminal episode involving the trafficking |
---|
107 | 100 | | of persons; |
---|
108 | 101 | | (B) demographic information on persons who are |
---|
109 | 102 | | convicted of offenses described by Paragraph (A) and persons who |
---|
110 | 103 | | are the victims of those offenses; |
---|
111 | 104 | | (C) geographic routes by which human trafficking |
---|
112 | 105 | | victims are trafficked, including routes by which victims are |
---|
113 | 106 | | trafficked across this state's international border, and |
---|
114 | 107 | | geographic patterns in human trafficking, including the country or |
---|
115 | 108 | | state of origin and the country or state of destination; |
---|
116 | 109 | | (D) means of transportation and methods used by |
---|
117 | 110 | | persons who engage in trafficking to transport their victims; and |
---|
118 | 111 | | (E) social and economic factors that create a |
---|
119 | 112 | | demand for the labor or services that victims of human trafficking |
---|
120 | 113 | | are forced to provide; |
---|
121 | 114 | | (5) work with the Texas Commission on Law Enforcement |
---|
122 | 115 | | [Officer Standards and Education] to develop and conduct training |
---|
123 | 116 | | for law enforcement personnel, victim service providers, and |
---|
124 | 117 | | medical service providers to identify victims of human trafficking; |
---|
125 | 118 | | (6) work with the Texas Education Agency, the |
---|
126 | 119 | | Department of Family and Protective Services, and the Health and |
---|
127 | 120 | | Human Services Commission to: |
---|
128 | 121 | | (A) develop a list of key indicators that a |
---|
129 | 122 | | person is a victim of human trafficking; |
---|
130 | 123 | | (B) develop a standardized curriculum for |
---|
131 | 124 | | training doctors, nurses, emergency medical services personnel, |
---|
132 | 125 | | teachers, school counselors, school administrators, and personnel |
---|
133 | 126 | | from the Department of Family and Protective Services and the |
---|
134 | 127 | | Health and Human Services Commission to identify and assist victims |
---|
135 | 128 | | of human trafficking; |
---|
136 | 129 | | (C) train doctors, nurses, emergency medical |
---|
137 | 130 | | services personnel, teachers, school counselors, school |
---|
138 | 131 | | administrators, and personnel from the Department of Family and |
---|
139 | 132 | | Protective Services and the Health and Human Services Commission to |
---|
140 | 133 | | identify and assist victims of human trafficking; |
---|
141 | 134 | | (D) develop and conduct training for personnel |
---|
142 | 135 | | from the Department of Family and Protective Services and the |
---|
143 | 136 | | Health and Human Services Commission on methods for identifying |
---|
144 | 137 | | children in foster care who may be at risk of becoming victims of |
---|
145 | 138 | | human trafficking; and |
---|
146 | 139 | | (E) develop a process for referring identified |
---|
147 | 140 | | human trafficking victims and individuals at risk of becoming |
---|
148 | 141 | | victims to appropriate entities for services; |
---|
149 | 142 | | (7) on the request of a judge of a county court, county |
---|
150 | 143 | | court at law, or district court or a county attorney, district |
---|
151 | 144 | | attorney, or criminal district attorney, assist and train the judge |
---|
152 | 145 | | or the judge's staff or the attorney or the attorney's staff in the |
---|
153 | 146 | | recognition and prevention of human trafficking; |
---|
154 | 147 | | (8) examine training protocols related to human |
---|
155 | 148 | | trafficking issues, as developed and implemented by federal, state, |
---|
156 | 149 | | and local law enforcement agencies; |
---|
157 | 150 | | (9) collaborate with state and local governmental |
---|
158 | 151 | | agencies, political subdivisions of the state, and nongovernmental |
---|
159 | 152 | | organizations to implement a media awareness campaign in |
---|
160 | 153 | | communities affected by human trafficking; |
---|
161 | 154 | | (10) develop recommendations on how to strengthen |
---|
162 | 155 | | state and local efforts to prevent human trafficking, protect and |
---|
163 | 156 | | assist human trafficking victims, and prosecute human trafficking |
---|
164 | 157 | | offenders; [and] |
---|
165 | 158 | | (11) examine the extent to which human trafficking is |
---|
166 | 159 | | associated with the operation of sexually oriented businesses, as |
---|
167 | 160 | | defined by Section 243.002, Local Government Code, and the |
---|
168 | 161 | | workplace or public health concerns that are created by the |
---|
169 | 162 | | association of human trafficking and the operation of sexually |
---|
170 | 163 | | oriented businesses; and |
---|
171 | 164 | | (12) develop recommendations for addressing the |
---|
172 | 165 | | demand for forced labor or services or sexual conduct involving |
---|
173 | 166 | | victims of human trafficking, including recommendations for |
---|
174 | 167 | | increased penalties for individuals who engage or attempt to engage |
---|
175 | 168 | | in prostitution with victims younger than 18 years of age. |
---|
176 | 169 | | (h) This section expires September 1, 2017 [2015]. |
---|
177 | 170 | | SECTION 2. This Act takes effect immediately if it receives |
---|
178 | 171 | | a vote of two-thirds of all the members elected to each house, as |
---|
179 | 172 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
180 | 173 | | Act does not receive the vote necessary for immediate effect, this |
---|
181 | 174 | | Act takes effect September 1, 2015. |
