215 relating to a preventive services program and mental health
226 programs for veterans and military families.
237 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
248 SECTION 1. Subtitle E, Title 2, Human Resources Code, is
259 amended by adding Chapter 53 to read as follows:
2610 CHAPTER 53. PREVENTIVE SERVICES FOR VETERANS AND MILITARY FAMILIES
2711 Sec. 53.001. DEFINITIONS. In this chapter:
2812 (1) "Department" means the Department of Family and
2913 Protective Services.
3014 (2) "Veteran" means a person who has served in:
3115 (A) the army, navy, air force, coast guard, or
3216 marine corps of the United States;
3317 (B) the state military forces as defined by
3418 Section 431.001, Government Code; or
3519 (C) an auxiliary service of one of those branches
3620 of the armed forces.
3721 Sec. 53.002. VETERANS AND MILITARY FAMILIES PREVENTIVE
3822 SERVICES PROGRAM. (a) The department shall develop and implement a
3923 preventive services program to serve veterans and military families
4024 who have committed or experienced or who are at a high risk of:
4125 (1) family violence; or
4226 (2) abuse or neglect.
4327 (b) The program must:
4428 (1) be designed to coordinate with community-based
4529 organizations to provide prevention services;
4630 (2) include a prevention component and an early
4731 intervention component;
4832 (3) include collaboration with services for child
4933 welfare, services for early childhood education, and other child
5034 and family services programs; and
5135 (4) coordinate with the community collaboration
5236 initiative developed under Subchapter I, Chapter 434, Government
5337 Code, and committees formed by local communities as part of that
5438 initiative.
5539 (c) The program must be established initially as a pilot
5640 program in areas of the state in which the department considers the
5741 implementation practicable. The department shall evaluate the
5842 outcomes of the pilot program and ensure that the program is
5943 producing positive results before implementing the program
6044 throughout the state.
6145 (d) The department shall evaluate the program and prepare an
6246 annual report on the outcomes of the program. The department shall
6347 publish the report on the department's Internet website.
6448 SECTION 2. Chapter 434, Government Code, is amended by
6549 adding Subchapters H and I to read as follows:
6650 SUBCHAPTER H. STATEWIDE COORDINATION OF MENTAL HEALTH
6751 PROGRAM FOR VETERANS
6852 Sec. 434.351. DEFINITIONS. In this subchapter:
6953 (1) "Commission" means the Texas Veterans Commission.
7054 (2) "Peer" means a person who is a veteran or a
7155 veteran's family member.
7256 (3) "Veteran" means a person who has served in:
7357 (A) the army, navy, air force, coast guard, or
7458 marine corps of the United States;
7559 (B) the state military forces as defined by
7660 Section 431.001; or
7761 (C) an auxiliary service of one of those branches
7862 of the armed forces.
7963 (4) "Volunteer coordinator" means a person who
8064 recruits and retains veterans, peers, and volunteers to participate
8165 in the mental health program for veterans and related activities.
8266 Sec. 434.352. DUTIES. (a) The commission and the
8367 Department of State Health Services shall coordinate to administer
8468 the mental health program for veterans developed under Chapter
8569 1001, Health and Safety Code.
8670 (b) For the mental health program for veterans, the
8771 commission shall:
8872 (1) provide training to volunteer coordinators and
8973 peers in accordance with Section 434.353;
9074 (2) provide technical assistance to volunteer
9175 coordinators and peers;
9276 (3) recruit, train, and communicate with
9377 community-based therapists, community-based organizations, and
9478 faith-based organizations; and
9579 (4) coordinate services for justice involved
9680 veterans.
9781 (c) The executive director of the commission shall appoint a
9882 program director to administer the mental health program for
9983 veterans.
10084 (d) The commission shall provide appropriate facilities in
10185 support of the mental health program for veterans to the extent
10286 funding is available for that purpose.
10387 Sec. 434.353. TRAINING AND CERTIFICATION. (a) The
10488 commission shall develop and implement methods for providing
10589 volunteer coordinator certification training to volunteer
10690 coordinators, including providing training for initial
10791 certification and recertification and providing continuing
10892 education.
10993 (b) The commission shall manage and coordinate the peer
11094 training program to include initial training, advanced training,
11195 certification, and continuing education for peers associated with
11296 the mental health program for veterans.
11397 SUBCHAPTER I. COMMUNITY COLLABORATION INITIATIVE
11498 Sec. 434.401. COMMUNITY COLLABORATION. (a) The commission
11599 and the Department of State Health Services shall include as a part
116100 of the mental health program for veterans described by Section
117101 434.352(a) an initiative to encourage local communities to conduct
118102 cross-sector collaboration to synchronize locally accessible
119103 resources available for veterans and military service members.
120104 (b) The initiative must be designed to encourage local
121105 communities to form a committee that is tasked with developing a
122106 plan to identify and support the needs of veterans and military
123107 service members residing in their community. The commission may
124108 designate general areas of focus for the initiative.
125109 SECTION 3. This Act takes effect immediately if it receives
126110 a vote of two-thirds of all the members elected to each house, as
127111 provided by Section 39, Article III, Texas Constitution. If this
128112 Act does not receive the vote necessary for immediate effect, this
129113 Act takes effect September 1, 2015.
