55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to public meetings of joint airport boards.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 551.001(3), Government Code, is amended
1010 to read as follows:
1111 (3) "Governmental body" means:
1212 (A) a board, commission, department, committee,
1313 or agency within the executive or legislative branch of state
1414 government that is directed by one or more elected or appointed
1515 members;
1616 (B) a county commissioners court in the state;
1717 (C) a municipal governing body in the state;
1818 (D) a deliberative body that has rulemaking or
1919 quasi-judicial power and that is classified as a department,
2020 agency, or political subdivision of a county or municipality;
2121 (E) a school district board of trustees;
2222 (F) a county board of school trustees;
2323 (G) a county board of education;
2424 (H) the governing board of a special district
2525 created by law;
2626 (I) a local workforce development board created
2727 under Section 2308.253;
2828 (J) a nonprofit corporation that is eligible to
2929 receive funds under the federal community services block grant
3030 program and that is authorized by this state to serve a geographic
3131 area of the state; [and]
3232 (K) a nonprofit corporation organized under
3333 Chapter 67, Water Code, that provides a water supply or wastewater
3434 service, or both, and is exempt from ad valorem taxation under
3535 Section 11.30, Tax Code; and
3636 (L) a joint board created under Section 22.074,
3737 Transportation Code.
3838 SECTION 2. Subchapter C, Chapter 551, Government Code, is
3939 amended by adding Section 551.0501 to read as follows:
4040 Sec. 551.0501. JOINT BOARD: PLACE OF POSTING NOTICE.
4141 (a) In this section, "electronic bulletin board" means an
4242 electronic communication system that includes a perpetually
4343 illuminated screen on which the governmental body can post messages
4444 or notices viewable without manipulation by the public.
4545 (b) A joint board created under Section 22.074,
4646 Transportation Code, shall post notice of each meeting on a
4747 physical or electronic bulletin board at a place convenient to the
4848 public in the board's administrative offices.
4949 SECTION 3. The heading to Section 551.056, Government Code,
5050 is amended to read as follows:
5151 Sec. 551.056. ADDITIONAL POSTING REQUIREMENTS FOR CERTAIN
5252 MUNICIPALITIES, COUNTIES, SCHOOL DISTRICTS, JUNIOR COLLEGE
5353 DISTRICTS, [AND] DEVELOPMENT CORPORATIONS, AUTHORITIES, AND JOINT
5454 BOARDS.
5555 SECTION 4. Section 551.056(b), Government Code, is amended
5656 to read as follows:
5757 (b) In addition to the other place at which notice is
5858 required to be posted by this subchapter, the following
5959 governmental bodies and economic development corporations must
6060 also concurrently post notice of a meeting on the Internet website
6161 of the governmental body or economic development corporation:
6262 (1) a municipality;
6363 (2) a county;
6464 (3) a school district;
6565 (4) the governing body of a junior college or junior
6666 college district, including a college or district that has changed
6767 its name in accordance with Chapter 130, Education Code;
6868 (5) a development corporation organized under the
6969 Development Corporation Act (Subtitle C1, Title 12, Local
7070 Government Code); [and]
7171 (6) a regional mobility authority included within the
7272 meaning of an "authority" as defined by Section 370.003,
7373 Transportation Code; and
7474 (7) a joint board created under Section 22.074,
7575 Transportation Code.
7676 SECTION 5. The change in law made by this Act applies only
7777 to notice that is required to be posted on or after the effective
7878 date of this Act. Notice that is required to be posted prior to the
7979 effective date of this Act is governed by the law in effect at that
8080 time, and that law is continued in effect for that purpose.
8181 SECTION 6. This Act takes effect immediately if it receives
8282 a vote of two-thirds of all the members elected to each house, as
8383 provided by Section 39, Article III, Texas Constitution. If this
8484 Act does not receive the vote necessary for immediate effect, this
8585 Act takes effect September 1, 2015.
