85 AN ACT
96 relating to the definition of "non-physician mental health
107 professional" for purposes of the Texas Mental Health Code.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Section 571.003(15), Health and Safety Code, is
1310 amended to read as follows:
1411 (15) "Non-physician mental health professional"
1512 means:
1613 (A) a person who is:
1714 (i) a psychologist licensed to practice in
1815 this state and designated as a health-service provider;
1916 (ii) [(B)] a registered nurse with a
2017 master's or doctoral degree in psychiatric nursing;
2118 (iii) [(C)] a licensed clinical social
2219 worker;
2320 (iv) [(D)] a licensed professional
24- counselor licensed to practice in this state; or
21+ counselor licensed to practice in this state; [or]
2522 (v) [(E)] a licensed marriage and family
2623 therapist licensed to practice in this state; or
27- (B) a person who is a licensed occupational
28- therapist licensed to practice in this state, except that this
29- subdivision does not authorize an occupational therapist to perform
30- a service described by Section 454.006(c), Occupations Code.
24+ (vi) a licensed physician assistant; or
25+ (B) a person:
26+ (i) whose practice does not include
27+ diagnosis or psychological services of the type typically performed
28+ by:
29+ (a) a psychologist licensed to
30+ practice in this state and designated as a health-service provider;
31+ (b) a registered nurse with a master's
32+ or doctoral degree in psychiatric nursing;
33+ (c) a licensed clinical social
34+ worker;
35+ (d) a licensed professional counselor
36+ licensed to practice in this state; or
37+ (e) a licensed marriage and family
38+ therapist licensed to practice in this state; and
39+ (ii) who is a licensed occupational
40+ therapist
41+ licensed to practice in this state.
3142 SECTION 2. This Act takes effect September 1, 2015.
