115 relating to creating the offense of voyeurism; providing a penalty.
126 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
137 SECTION 1. Chapter 21, Penal Code, is amended by adding
148 Section 21.16 to read as follows:
159 Sec. 21.16. VOYEURISM. (a) A person commits an offense if
1610 the person, with the intent to arouse or gratify the sexual desire
1711 of the actor, observes another person without the other person's
1812 consent while the other person is in a dwelling or structure in
1913 which the other person has a reasonable expectation of privacy.
2014 (b) Except as provided by Subsection (c) or (d), an offense
2115 under this section is a Class C misdemeanor.
2216 (c) An offense under this section is a Class B misdemeanor
2317 if it is shown on the trial of the offense that the actor has
2418 previously been convicted two or more times of an offense under this
2519 section.
2620 (d) An offense under this section is a state jail felony if
2721 the victim was a child younger than 14 years of age at the time of
2822 the offense.
2923 (e) If conduct that constitutes an offense under this
3024 section also constitutes an offense under any other law, the actor
3125 may be prosecuted under this section, the other law, or both.
3226 SECTION 2. This Act takes effect September 1, 2015.
