| 12 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 7 | | SECTION 1. Chapter 21, Penal Code, is amended by adding |
|---|
| 14 | 8 | | Section 21.16 to read as follows: |
|---|
| 15 | 9 | | Sec. 21.16. VOYEURISM. (a) A person commits an offense if |
|---|
| 16 | 10 | | the person, with the intent to arouse or gratify the sexual desire |
|---|
| 17 | 11 | | of the actor, observes another person without the other person's |
|---|
| 18 | 12 | | consent while the other person is in a dwelling or structure in |
|---|
| 19 | 13 | | which the other person has a reasonable expectation of privacy. |
|---|
| 20 | 14 | | (b) Except as provided by Subsection (c) or (d), an offense |
|---|
| 21 | 15 | | under this section is a Class C misdemeanor. |
|---|
| 22 | 16 | | (c) An offense under this section is a Class B misdemeanor |
|---|
| 23 | 17 | | if it is shown on the trial of the offense that the actor has |
|---|
| 24 | 18 | | previously been convicted two or more times of an offense under this |
|---|
| 25 | 19 | | section. |
|---|
| 26 | 20 | | (d) An offense under this section is a state jail felony if |
|---|
| 27 | 21 | | the victim was a child younger than 14 years of age at the time of |
|---|
| 28 | 22 | | the offense. |
|---|
| 29 | 23 | | (e) If conduct that constitutes an offense under this |
|---|
| 30 | 24 | | section also constitutes an offense under any other law, the actor |
|---|
| 31 | 25 | | may be prosecuted under this section, the other law, or both. |

| 32 | 26 | | SECTION 2. This Act takes effect September 1, 2015. |
