10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 574.108(b), Health and Safety Code, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | (b) An order authorizing the administration of medication | |
14 | 14 | regardless of the refusal of the patient is stayed [effective] | |
15 | 15 | pending an appeal of the order. | |
16 | 16 | SECTION 2. The change in law made by this Act applies only | |
17 | 17 | to an appeal of an order authorizing the administration of | |
18 | 18 | medication to a patient receiving court-ordered inpatient mental | |
19 | 19 | health services that is filed on or after the effective date of this | |
20 | 20 | Act. An appeal filed before the effective date of this Act is | |
21 | 21 | governed by the law in effect when the appeal was filed, and the | |
22 | 22 | former law is continued in effect for that purpose. | |
23 | 23 | SECTION 3. This Act takes effect September 1, 2015. |
