55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the appeal of an order authorizing the administration
88 of medication to a patient receiving court-ordered inpatient mental
99 health services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 574.108(b), Health and Safety Code, is
1212 amended to read as follows:
1313 (b) An order authorizing the administration of medication
1414 regardless of the refusal of the patient is stayed [effective]
1515 pending an appeal of the order.
1616 SECTION 2. The change in law made by this Act applies only
1717 to an appeal of an order authorizing the administration of
1818 medication to a patient receiving court-ordered inpatient mental
1919 health services that is filed on or after the effective date of this
2020 Act. An appeal filed before the effective date of this Act is
2121 governed by the law in effect when the appeal was filed, and the
2222 former law is continued in effect for that purpose.
2323 SECTION 3. This Act takes effect September 1, 2015.
