| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 39.054, Education Code, is amended by |
|---|
| 10 | 10 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (a) The commissioner shall adopt rules to evaluate school |
|---|
| 13 | 13 | | district and campus performance and assign each district and campus |
|---|
| 14 | 14 | | a performance rating of A, B, C, D, or F. In adopting rules under |
|---|
| 15 | 15 | | this subsection, the commissioner shall determine the criteria for |
|---|
| 16 | 16 | | each designated letter performance rating. A district or campus |
|---|
| 17 | 17 | | performance rating of A reflects exemplary performance. A district |
|---|
| 18 | 18 | | or campus performance rating of B reflects recognized performance. |
|---|
| 19 | 19 | | A district or campus performance rating of [, B, or] C reflects |
|---|
| 20 | 20 | | acceptable performance. A [and a] district or campus performance |
|---|
| 21 | 21 | | rating of D or F reflects unacceptable performance. [The |
|---|
| 22 | 22 | | commissioner shall also assign each campus a performance rating of |
|---|
| 23 | 23 | | exemplary, recognized, acceptable, or unacceptable. A campus |
|---|
| 24 | 24 | | performance rating of exemplary, recognized, or acceptable |
|---|
| 25 | 25 | | reflects acceptable performance, and a campus performance rating of |
|---|
| 26 | 26 | | unacceptable reflects unacceptable performance.] A district may |
|---|
| 27 | 27 | | not receive a performance rating of A if the district includes any |
|---|
| 28 | 28 | | campus with a performance rating of D or F [unacceptable]. A |
|---|
| 29 | 29 | | reference in law to an acceptable rating or acceptable performance |
|---|
| 30 | 30 | | includes a performance rating of A or B or exemplary or recognized |
|---|
| 31 | 31 | | performance. |
|---|
| 32 | 32 | | (a-1) Not later than August 8 of each year, the performance |
|---|
| 33 | 33 | | rating of each district and campus shall be made publicly available |
|---|
| 34 | 34 | | as provided by rules adopted under this section [subsection]. If a |
|---|
| 35 | 35 | | district or campus received a performance rating of D or F [that |
|---|
| 36 | 36 | | reflected unacceptable performance] for the preceding school year, |
|---|
| 37 | 37 | | the commissioner shall notify the district of a subsequent such |
|---|
| 38 | 38 | | designation on or before June 15. |
|---|
| 39 | 39 | | SECTION 2. Section 44(b), Chapter 211 (H.B. 5), Acts of the |
|---|
| 40 | 40 | | 83rd Legislature, Regular Session, 2013, is repealed. |
|---|
| 41 | 41 | | SECTION 3. This Act applies beginning with the 2015-2016 |
|---|
| 42 | 42 | | school year. |
|---|
| 43 | 43 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 47 | | Act takes effect September 1, 2015. |
