77 relating to public school performance ratings.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 39.054, Education Code, is amended by
1010 amending Subsection (a) and adding Subsection (a-1) to read as
1111 follows:
1212 (a) The commissioner shall adopt rules to evaluate school
1313 district and campus performance and assign each district and campus
1414 a performance rating of A, B, C, D, or F. In adopting rules under
1515 this subsection, the commissioner shall determine the criteria for
1616 each designated letter performance rating. A district or campus
1717 performance rating of A reflects exemplary performance. A district
1818 or campus performance rating of B reflects recognized performance.
1919 A district or campus performance rating of [, B, or] C reflects
2020 acceptable performance. A [and a] district or campus performance
2121 rating of D or F reflects unacceptable performance. [The
2222 commissioner shall also assign each campus a performance rating of
2323 exemplary, recognized, acceptable, or unacceptable. A campus
2424 performance rating of exemplary, recognized, or acceptable
2525 reflects acceptable performance, and a campus performance rating of
2626 unacceptable reflects unacceptable performance.] A district may
2727 not receive a performance rating of A if the district includes any
2828 campus with a performance rating of D or F [unacceptable]. A
2929 reference in law to an acceptable rating or acceptable performance
3030 includes a performance rating of A or B or exemplary or recognized
3131 performance.
3232 (a-1) Not later than August 8 of each year, the performance
3333 rating of each district and campus shall be made publicly available
3434 as provided by rules adopted under this section [subsection]. If a
3535 district or campus received a performance rating of D or F [that
3636 reflected unacceptable performance] for the preceding school year,
3737 the commissioner shall notify the district of a subsequent such
3838 designation on or before June 15.
3939 SECTION 2. Section 44(b), Chapter 211 (H.B. 5), Acts of the
4040 83rd Legislature, Regular Session, 2013, is repealed.
4141 SECTION 3. This Act applies beginning with the 2015-2016
4242 school year.
4343 SECTION 4. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2015.
