9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter C, Chapter 39, Utilities Code, is | |
11 | 11 | amended by adding Section 39.113 to read as follows: | |
12 | 12 | Sec. 39.113. CERTAIN USAGE FEES OR CREDITS. A retail | |
13 | 13 | electric provider may not bill a customer for a charge or fee or | |
14 | 14 | award a customer a bill credit based on whether the customer has | |
15 | 15 | used at least a certain amount of electricity in a particular | |
16 | 16 | period. | |
17 | 17 | SECTION 2. The change in law made by this Act applies only | |
18 | 18 | to a contract between a customer and a retail electric provider | |
19 | 19 | entered into on or after the effective date of this Act. A contract | |
20 | 20 | between a customer and a retail electric provider entered into | |
21 | 21 | before the effective date of this Act is governed by the law in | |
22 | 22 | effect when the contract was entered into, and the former law is | |
23 | 23 | continued in effect for that purpose. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2015. |
