55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain fees, charges, or credits based on a customer's
88 electricity use in areas where competition has been introduced.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 39, Utilities Code, is
1111 amended by adding Section 39.113 to read as follows:
1212 Sec. 39.113. CERTAIN USAGE FEES OR CREDITS. A retail
1313 electric provider may not bill a customer for a charge or fee or
1414 award a customer a bill credit based on whether the customer has
1515 used at least a certain amount of electricity in a particular
1616 period.
1717 SECTION 2. The change in law made by this Act applies only
1818 to a contract between a customer and a retail electric provider
1919 entered into on or after the effective date of this Act. A contract
2020 between a customer and a retail electric provider entered into
2121 before the effective date of this Act is governed by the law in
2222 effect when the contract was entered into, and the former law is
2323 continued in effect for that purpose.
2424 SECTION 3. This Act takes effect September 1, 2015.
