 A BILL TO BE ENTITLED
 AN ACT
 relating to certain fees, charges, or credits based on a customer's
 electricity use in areas where competition has been introduced.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter C, Chapter 39, Utilities Code, is
 amended by adding Section 39.113 to read as follows:
 Sec. 39.113.  CERTAIN USAGE FEES OR CREDITS. A retail
 electric provider may not bill a customer for a charge or fee or
 award a customer a bill credit based on whether the customer has
 used at least a certain amount of electricity in a particular
 period.
 SECTION 2.  The change in law made by this Act applies only
 to a contract between a customer and a retail electric provider
 entered into on or after the effective date of this Act. A contract
 between a customer and a retail electric provider entered into
 before the effective date of this Act is governed by the law in
 effect when the contract was entered into, and the former law is
 continued in effect for that purpose.
 SECTION 3.  This Act takes effect September 1, 2015.
