| 14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 8 | | SECTION 1. Subchapter F, Chapter 2175, Government Code, is |
|---|
| 16 | 9 | | amended by adding Section 2175.308 to read as follows: |
|---|
| 17 | 10 | | Sec. 2175.308. EXCEPTION FOR CERTAIN PROPERTY OF DEPARTMENT |
|---|
| 18 | 11 | | OF PUBLIC SAFETY. (a) Notwithstanding any conflicting provision |
|---|
| 19 | 12 | | of this chapter, if the commission determines that this state's |
|---|
| 20 | 13 | | efforts to secure this state's international border and combat |
|---|
| 21 | 14 | | transnational crime will sufficiently benefit from the donation of |
|---|
| 22 | 15 | | the surplus motor vehicles and other law enforcement equipment of |
|---|
| 23 | 16 | | the Department of Public Safety of the State of Texas to a municipal |
|---|
| 24 | 17 | | or county law enforcement agency in an economically disadvantaged |
|---|
| 25 | 18 | | area of this state, the commission may transfer the property to the |
|---|
| 26 | 19 | | agency at a price or for other consideration agreed to by the |
|---|
| 27 | 20 | | commission and the agency. |
|---|
| 28 | 21 | | (b) A law enforcement agency that receives surplus property |
|---|
| 29 | 22 | | under Subsection (a) may not sell the property before the second |
|---|
| 30 | 23 | | anniversary of the date the property is received. |

| 31 | 24 | | SECTION 2. This Act takes effect September 1, 2015. |
