9- A BILL TO BE ENTITLED
104 AN ACT
115 relating to a landowner's liability for injuries incurred during
126 certain recreational activities.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 75.001(3), Civil Practice and Remedies
159 Code, is amended to read as follows:
1610 (3) "Recreation" means an activity such as:
1711 (A) hunting;
1812 (B) fishing;
1913 (C) swimming;
2014 (D) boating;
2115 (E) camping;
2216 (F) picnicking;
2317 (G) hiking;
2418 (H) pleasure driving, including off-road
2519 motorcycling and off-road automobile driving and the use of
2620 all-terrain vehicles and recreational off-highway vehicles;
2721 (I) nature study, including bird-watching;
2822 (J) cave exploration;
2923 (K) waterskiing and other water sports;
3024 (L) any other activity associated with enjoying
3125 nature or the outdoors;
3226 (M) bicycling and mountain biking;
3327 (N) disc golf;
3428 (O) on-leash and off-leash walking of dogs; or
3529 (P) radio control flying and related activities.
3630 SECTION 2. The change in law made by this Act applies only
3731 to a cause of action that accrues on or after the effective date of
3832 this Act. A cause of action that accrues before the effective date
3933 of this Act is governed by the law in effect immediately before the
4034 effective date of this Act, and that law is continued in effect for
4135 that purpose.
4236 SECTION 3. This Act takes effect immediately if it receives
4337 a vote of two-thirds of all the members elected to each house, as
4438 provided by Section 39, Article III, Texas Constitution. If this
4539 Act does not receive the vote necessary for immediate effect, this
4640 Act takes effect September 1, 2015.
