88 AN ACT
99 relating to the failure to handle certain animals in accordance
1010 with rules of the Texas Animal Health Commission; amending
1111 provisions subject to a criminal penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 161.041(c), Agriculture Code, is amended
1414 to read as follows:
1515 (c) A person commits an offense if the person knowingly
1616 fails to handle, in accordance with rules adopted by the
1717 commission, livestock, exotic livestock, domestic fowl, or exotic
1818 fowl:
1919 (1) infected with a disease listed in Subsection (a);
2020 (2) exposed, as defined by commission rule, to a
2121 disease listed in Subsection (a) if the commission has notified the
2222 person that the animal was exposed to the disease; or
2323 (3) subject to a testing requirement due to a risk of
2424 exposure, as defined by commission rule, to a specific disease if
2525 the commission has notified the person of the testing requirement.
2626 SECTION 2. The change in law made by this Act applies only
2727 to an offense committed on or after the effective date of this Act.
2828 An offense committed before the effective date of this Act is
2929 governed by the law in effect on the date the offense was committed,
3030 and the former law is continued in effect for that purpose. For
3131 purposes of this section, an offense was committed before the
3232 effective date of this Act if any element of the offense occurred
3333 before that date.
3434 SECTION 3. This Act takes effect September 1, 2015.
