| 10 | 10 | | with rules of the Texas Animal Health Commission; amending |

| 11 | 11 | | provisions subject to a criminal penalty. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 161.041(c), Agriculture Code, is amended |
|---|
| 14 | 14 | | to read as follows: |
|---|
| 15 | 15 | | (c) A person commits an offense if the person knowingly |
|---|
| 16 | 16 | | fails to handle, in accordance with rules adopted by the |
|---|
| 17 | 17 | | commission, livestock, exotic livestock, domestic fowl, or exotic |
|---|
| 18 | 18 | | fowl: |
|---|
| 19 | 19 | | (1) infected with a disease listed in Subsection (a); |
|---|
| 20 | 20 | | (2) exposed, as defined by commission rule, to a |
|---|
| 21 | 21 | | disease listed in Subsection (a) if the commission has notified the |
|---|
| 22 | 22 | | person that the animal was exposed to the disease; or |
|---|
| 23 | 23 | | (3) subject to a testing requirement due to a risk of |
|---|
| 24 | 24 | | exposure, as defined by commission rule, to a specific disease if |
|---|
| 25 | 25 | | the commission has notified the person of the testing requirement. |

| 26 | 26 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 27 | 27 | | to an offense committed on or after the effective date of this Act. |
|---|
| 28 | 28 | | An offense committed before the effective date of this Act is |
|---|
| 29 | 29 | | governed by the law in effect on the date the offense was committed, |
|---|
| 30 | 30 | | and the former law is continued in effect for that purpose. For |
|---|
| 31 | 31 | | purposes of this section, an offense was committed before the |
|---|
| 32 | 32 | | effective date of this Act if any element of the offense occurred |
|---|
| 33 | 33 | | before that date. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2015. |
