66 AN ACT
77 relating to conflicts of interest and discrimination policies for
88 an ethics or medical committee review of an advance directive.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 166, Health and Safety
1111 Code, is amended by adding Section 166.0465 to read as follows:
1212 Sec. 166.0465. ETHICS OR MEDICAL COMMITTEE POLICIES ON
1313 CONFLICTS OF INTEREST AND DISCRIMINATION. Each health care
1414 facility that provides review by an ethics or medical committee
1515 under Section 166.046 shall adopt and implement:
1616 (1) a policy to prevent financial and health care
1717 professional conflicts of interest that may arise during a review
1818 under that section; and
1919 (2) a policy to prohibit consideration of a patient's
2020 permanent physical or mental disability during a review under that
2121 section unless the disability is relevant in determining whether a
2222 medical or surgical intervention is medically appropriate.
2323 SECTION 2. (a) A health care facility shall adopt the
2424 policies required by Section 166.0465, Health and Safety Code, as
2525 added by this Act, not later than April 1, 2016.
2626 (b) The policies adopted under Section 166.0465, Health and
2727 Safety Code, as added by this Act, apply to an ethics or medical
2828 committee review conducted on or after April 1, 2016.
2929 SECTION 3. This Act takes effect September 1, 2015.
