12 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 11 | | SECTION 1. Section 42.041, Human Resources Code, is amended |
---|
14 | 12 | | by adding Subsection (h) to read as follows: |
---|
15 | 13 | | (h) Notwithstanding Subsection (b)(7), a residential |
---|
16 | 14 | | educational facility that is accredited by an accreditation body |
---|
17 | 15 | | that is a member of the Texas Private School Accreditation |
---|
18 | 16 | | Commission and operates primarily for educational purposes for |
---|
19 | 17 | | prekindergarten and above shall comply with the licensing |
---|
20 | 18 | | requirements of Subsection (a) and all department rules and minimum |
---|
21 | 19 | | standards applicable to general residential operations that |
---|
22 | 20 | | provide services to persons who are victims of human trafficking |
---|
23 | 21 | | under Section 20A.02, Penal Code, if: |
---|
24 | 22 | | (1) at any point during the academic year more than |
---|
25 | 23 | | either 25 children at the facility or 30 percent of the children at |
---|
26 | 24 | | the facility are victims of human trafficking; and |
---|
27 | 25 | | (2) the facility provides or intends to provide |
---|
28 | 26 | | specialized services designed to treat and support trafficking |
---|
29 | 27 | | victims in addition to providing basic child care services. |

30 | 28 | | SECTION 2. This Act takes effect September 1, 2015. |
