97 relating to the licensing and regulation of certain residential
108 educational child-care facilities serving victims of human
119 trafficking.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Section 42.041, Human Resources Code, is amended
1412 by adding Subsection (h) to read as follows:
1513 (h) Notwithstanding Subsection (b)(7), a residential
1614 educational facility that is accredited by an accreditation body
1715 that is a member of the Texas Private School Accreditation
1816 Commission and operates primarily for educational purposes for
1917 prekindergarten and above shall comply with the licensing
2018 requirements of Subsection (a) and all department rules and minimum
2119 standards applicable to general residential operations that
2220 provide services to persons who are victims of human trafficking
2321 under Section 20A.02, Penal Code, if:
2422 (1) at any point during the academic year more than
2523 either 25 children at the facility or 30 percent of the children at
2624 the facility are victims of human trafficking; and
2725 (2) the facility provides or intends to provide
2826 specialized services designed to treat and support trafficking
2927 victims in addition to providing basic child care services.
3028 SECTION 2. This Act takes effect September 1, 2015.
