99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the establishment of a residential energy efficiency
1212 loan program.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Chapter 388, Health and Safety Code, is amended
1515 by adding Section 388.013 to read as follows:
1616 Sec. 388.013. ENERGY EFFICIENCY LOAN PROGRAM. (a) The
1717 comptroller and the State Energy Conservation Office by rule shall
1818 establish and administer a self-sustaining program that issues
1919 loans to be used for improvements that increase the energy
2020 efficiency of residences that are not newly constructed.
2121 (b) Rules adopted under this section must establish
2222 eligibility requirements for receipt of a loan issued under this
2323 section, including energy savings cost-effectiveness criteria.
2424 (c) The State Energy Conservation Office annually shall
2525 evaluate the effectiveness of the program established under this
2626 section and quantify energy savings realized as a result of the
2727 program.
2828 (d) Money from the general revenue fund may not be
2929 appropriated for the purpose of implementing the program
3030 established under this section.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2015.
