11	5		relating to the relationship between the Estates Code and the
12	6		former Texas Probate Code.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. (a) This section takes effect only if the Act of
15	9		the 84th Legislature, Regular Session, 2015, relating to
16	10		nonsubstantive additions to and corrections in enacted codes
17	11		becomes law.
18	12		(b) Section 21.002, Estates Code, is amended to read as
19	13		follows:
20	14		Sec. 21.002. CONSTRUCTION. (a) Except as provided by [this
21	15		section,] Section 22.027[,] or [Section] 1002.023, Chapter 311,
22	16		Government Code (Code Construction Act), applies to the
23	17		construction of a provision of this code.
24	18		(b) This code and the Texas Probate Code, as amended, shall
25	19		be considered one continuous statute, and for the purposes of any
26	20		instrument that refers to the Texas Probate Code, this code shall be
27	21		considered an amendment to the Texas Probate Code [Chapter 311,
28	22		Government Code (Code Construction Act), does not apply to the
29	23		construction of a provision of Subtitle X, Title 2, or Subtitle Y or
30	24		Z, Title 3].
31	25		SECTION 2. (a) This section takes effect only if the Act of
32	26		the 84th Legislature, Regular Session, 2015, relating to
33	27		nonsubstantive additions to and corrections in enacted codes does
34	28		not become law.
35	29		(b) Section 21.002, Estates Code, is amended by adding
36	30		Subsection (c) to read as follows:
37	31		(c) This code and the Texas Probate Code, as amended, shall
38	32		be considered one continuous statute, and for the purposes of any
39	33		instrument that refers to the Texas Probate Code, this code shall be
40	34		considered an amendment to the Texas Probate Code.
41	35		SECTION 3. This Act takes effect immediately if it receives
42	36		a vote of two-thirds of all the members elected to each house, as
43	37		provided by Section 39, Article III, Texas Constitution. If this
44	38		Act does not receive the vote necessary for immediate effect, this
45	39		Act takes effect September 1, 2015.
