99 relating to postconviction forensic DNA analysis.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 64.01(a-1), Code of Criminal Procedure,
1212 is amended to read as follows:
1313 (a-1) A convicted person may submit to the convicting court
1414 a motion for forensic DNA testing of evidence that has a reasonable
1515 likelihood of containing biological material. The motion must be
1616 accompanied by an affidavit, sworn to by the convicted person,
1717 containing statements of fact in support of the motion.
1818 SECTION 2. Article 64.03(a), Code of Criminal Procedure, is
1919 amended to read as follows:
2020 (a) A convicting court may order forensic DNA testing under
2121 this chapter only if:
2222 (1) the court finds that:
2323 (A) the evidence:
2424 (i) still exists and is in a condition
2525 making DNA testing possible; and
2626 (ii) has been subjected to a chain of
2727 custody sufficient to establish that it has not been substituted,
2828 tampered with, replaced, or altered in any material respect; [and]
2929 (B) there is a reasonable likelihood that the
3030 evidence contains biological material suitable for DNA testing; and
3131 (C) identity was or is an issue in the case; and
3232 (2) the convicted person establishes by a
3333 preponderance of the evidence that:
3434 (A) the person would not have been convicted if
3535 exculpatory results had been obtained through DNA testing; and
3636 (B) the request for the proposed DNA testing is
3737 not made to unreasonably delay the execution of sentence or
3838 administration of justice.
3939 SECTION 3. The change in law made by this Act applies to a
4040 motion for forensic DNA testing filed on or after the effective date
4141 of this Act. A motion for forensic DNA testing filed before the
4242 effective date of this Act is governed by the law in effect on the
4343 date the motion was filed, and the former law is continued in effect
4444 for that purpose.
4545 SECTION 4. This Act takes effect September 1, 2015.
