225 relating to the transfer of a plumber's license on the retirement or
236 death of the plumber.
247 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
258 SECTION 1. Section 1301.359(b), Occupations Code, is
269 amended to read as follows:
2710 (b) Except as provided by Section 1301.406, a [A] license,
2811 endorsement, or registration issued under this chapter is not
2912 assignable or transferable.
3013 SECTION 2. Subchapter H, Chapter 1301, Occupations Code, is
3114 amended by adding Section 1301.406 to read as follows:
3215 Sec. 1301.406. TRANSFER OF LICENSE. (a) On approval by the
3316 board, a person who holds an unexpired license under this chapter
3417 and whose license has been held continuously for at least 50
3518 consecutive years may transfer the license on the date of the
3619 person's retirement or death to another person who:
3720 (1) is related within the second degree by
3821 consanguinity to the transferor; and
3922 (2) holds a license as a journeyman plumber or master
4023 plumber under this chapter.
4124 (b) The application for a license transfer under this
4225 section must include the transferor's consent and a designation of
4326 whether the license will transfer on the retirement or death of the
4427 transferor.
4528 (c) The board shall transfer a license to a person who
4629 submits an application and presents evidence satisfactory to the
4730 board that:
4831 (1) the person meets the requirements under
4932 Subsections (a)(1) and (a)(2); and
5033 (2) the transferor is retired or dead.
5134 SECTION 3. As soon as practicable after the effective date
5235 of this Act, the Texas State Board of Plumbing Examiners shall adopt
5336 rules and prescribe forms necessary to implement the changes in law
5437 made by Section 1301.406, Occupations Code, as added by this Act.
5538 SECTION 4. Not later than January 1, 2016, the Texas State
5639 Board of Plumbing Examiners shall begin accepting applications for
5740 the transfer of licenses under Section 1301.406, Occupations Code,
5841 as added by this Act.
5942 SECTION 5. This Act takes effect September 1, 2015.
