55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of automatic location identification and
88 automatic tier two facility identification as part of the 9-1-1
99 system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 771.051(a), Health and Safety Code, is
1212 amended to read as follows:
1313 (a) The commission is the state's authority on emergency
1414 communications. The commission shall:
1515 (1) administer the implementation of statewide 9-1-1
1616 service and the poison control network, including poison control
1717 centers under Chapter 777;
1818 (2) develop minimum performance standards for
1919 equipment and operation of 9-1-1 service to be followed in
2020 developing regional plans under Section 771.055, including
2121 requirements that the plans provide for:
2222 (A) automatic number identification by which the
2323 telephone number of the caller is automatically identified at the
2424 public safety answering point receiving the call; [and]
2525 (B) automatic location identification, as
2626 defined by Section 772.001;
2727 (C) automatic tier two facility identification,
2828 as defined by Section 772.001; and
2929 (D) other features the commission considers
3030 appropriate;
3131 (3) examine and approve or disapprove regional plans
3232 as provided by Section 771.056;
3333 (4) recommend minimum training standards, assist in
3434 training, and provide assistance in the establishment and operation
3535 of 9-1-1 service;
3636 (5) allocate money to prepare and operate regional
3737 plans as provided by Section 771.056;
3838 (6) develop and provide public education materials and
3939 training;
4040 (7) plan, implement, operate, and maintain poison
4141 control center databases and assist in planning, supporting, and
4242 facilitating 9-1-1 databases, as needed;
4343 (8) provide grants or contracts for services that
4444 enhance the effectiveness of 9-1-1 service;
4545 (9) coordinate emergency communications services and
4646 providers;
4747 (10) make reasonable efforts to gain voluntary
4848 cooperation in the commission's activities of emergency
4949 communications authorities and providers outside the commission's
5050 jurisdiction, including:
5151 (A) making joint communications to state and
5252 federal regulators; and
5353 (B) arranging cooperative purchases of equipment
5454 or services; and
5555 (11) accept, receive, and deposit in its account in
5656 the general revenue fund gifts, grants, and royalties from public
5757 and private entities. Gifts, grants, and royalties may be used for
5858 the purposes of the commission.
5959 SECTION 2. Subchapter C, Chapter 771, Health and Safety
6060 Code, is amended by adding Section 771.0545 to read as follows:
6161 Sec. 771.0545. AUTOMATIC TIER TWO FACILITY IDENTIFICATION.
6262 An emergency communication district that does not participate in a
6363 regional plan shall provide automatic tier two facility
6464 identification as part of the 9-1-1 system.
6565 SECTION 3. Section 772.001, Health and Safety Code, is
6666 amended by adding Subdivision (22) to read as follows:
6767 (22) "Automatic tier two facility identification"
6868 means a feature corresponding to automatic location identification
6969 in which the address or location provided by the automatic location
7070 identification feature is matched with information indicating
7171 whether the address or location is a facility that is required to
7272 file a tier two form with the Department of State Health Services
7373 under Chapter 505, 506, or 507.
7474 SECTION 4. Subchapter A, Chapter 772, Health and Safety
7575 Code, is amended by adding Section 772.004 to read as follows:
7676 Sec. 772.004. AUTOMATIC TIER TWO FACILITY IDENTIFICATION.
7777 Notwithstanding any provision of this chapter or Chapter 771, an
7878 emergency communication district shall provide automatic tier two
7979 facility identification as part of the 9-1-1 system for each
8080 participating jurisdiction.
8181 SECTION 5. Subchapter D, Chapter 1001, Health and Safety
8282 Code, is amended by adding Section 1001.085 to read as follows:
8383 Sec. 1001.085. TIER TWO FACILITY LOCATION INFORMATION. The
8484 department shall provide the address or location of each facility
8585 that is required to file a tier two form with the department to the
8686 applicable regional planning commission or emergency communication
8787 district.
8888 SECTION 6. (a) The Commission on State Emergency
8989 Communications shall adopt the performance standards relating to
9090 automatic location identification and automatic tier two facility
9191 identification as required by Section 771.051(a), Health and Safety
9292 Code, as amended by this Act, not later than January 1, 2016.
9393 (b) Each regional planning commission, as that term is
9494 defined by Section 771.001, Health and Safety Code, shall submit an
9595 amendment to that commission's regional plan not later than
9696 February 1, 2016. The amendment must describe the procedures the
9797 regional planning commission will use to fully implement automatic
9898 tier two facility identification not later than March 1, 2016.
9999 (c) An emergency communication district shall fully
100100 implement automatic tier two facility identification as required by
101101 Sections 771.0545 and 772.004, Health and Safety Code, as added by
102102 this Act, not later than March 1, 2016.
103103 (d) The Department of State Health Services shall provide
104104 tier two facility location information as required by Section
105105 1001.085, Health and Safety Code, as added by this Act, not later
106106 than January 1, 2016.
107107 SECTION 7. This Act takes effect immediately if it receives
108108 a vote of two-thirds of all the members elected to each house, as
109109 provided by Section 39, Article III, Texas Constitution. If this
110110 Act does not receive the vote necessary for immediate effect, this
111111 Act takes effect September 1, 2015.
