6	6	AN ACT
7	7	relating to the provision of automatic location identification and
8	8	automatic tier two facility identification as part of the 9-1-1
9	9	system.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 771.051(a), Health and Safety Code, is
12	12	amended to read as follows:
13	13	(a) The commission is the state's authority on emergency
14	14	communications. The commission shall:
15	15	(1) administer the implementation of statewide 9-1-1
16	16	service and the poison control network, including poison control
17	17	centers under Chapter 777;
18	18	(2) develop minimum performance standards for
19	19	equipment and operation of 9-1-1 service to be followed in
20	20	developing regional plans under Section 771.055, including
21	21	requirements that the plans provide for:
22	22	(A) automatic number identification by which the
23	23	telephone number of the caller is automatically identified at the
24	24	public safety answering point receiving the call; [and]
25	25	(B) automatic location identification, as
26	26	defined by Section 772.001;
27	27	(C) automatic tier two facility identification,
28	28	as defined by Section 772.001; and
29	29	(D) other features the commission considers
30	30	appropriate;
31	31	(3) examine and approve or disapprove regional plans
32	32	as provided by Section 771.056;
33	33	(4) recommend minimum training standards, assist in
34	34	training, and provide assistance in the establishment and operation
35	35	of 9-1-1 service;
36	36	(5) allocate money to prepare and operate regional
37	37	plans as provided by Section 771.056;
38	38	(6) develop and provide public education materials and
39	39	training;
40	40	(7) plan, implement, operate, and maintain poison
41	41	control center databases and assist in planning, supporting, and
42	42	facilitating 9-1-1 databases, as needed;
43	43	(8) provide grants or contracts for services that
44	44	enhance the effectiveness of 9-1-1 service;
45	45	(9) coordinate emergency communications services and
46	46	providers;
47	47	(10) make reasonable efforts to gain voluntary
48	48	cooperation in the commission's activities of emergency
49	49	communications authorities and providers outside the commission's
50	50	jurisdiction, including:
51	51	(A) making joint communications to state and
52	52	federal regulators; and
53	53	(B) arranging cooperative purchases of equipment
54	54	or services; and
55	55	(11) accept, receive, and deposit in its account in
56	56	the general revenue fund gifts, grants, and royalties from public
57	57	and private entities. Gifts, grants, and royalties may be used for
58	58	the purposes of the commission.
59	59	SECTION 2. Subchapter C, Chapter 771, Health and Safety
60	60	Code, is amended by adding Section 771.0545 to read as follows:
61	61	Sec. 771.0545. AUTOMATIC TIER TWO FACILITY IDENTIFICATION.
62	62	An emergency communication district that does not participate in a
63	63	regional plan shall provide automatic tier two facility
64	64	identification as part of the 9-1-1 system.
65	65	SECTION 3. Section 772.001, Health and Safety Code, is
66	66	amended by adding Subdivision (22) to read as follows:
67	67	(22) "Automatic tier two facility identification"
68	68	means a feature corresponding to automatic location identification
69	69	in which the address or location provided by the automatic location
70	70	identification feature is matched with information indicating
71	71	whether the address or location is a facility that is required to
72	72	file a tier two form with the Department of State Health Services
73	73	under Chapter 505, 506, or 507.
74	74	SECTION 4. Subchapter A, Chapter 772, Health and Safety
75	75	Code, is amended by adding Section 772.004 to read as follows:
76	76	Sec. 772.004. AUTOMATIC TIER TWO FACILITY IDENTIFICATION.
77	77	Notwithstanding any provision of this chapter or Chapter 771, an
78	78	emergency communication district shall provide automatic tier two
79	79	facility identification as part of the 9-1-1 system for each
80	80	participating jurisdiction.
81	81	SECTION 5. Subchapter D, Chapter 1001, Health and Safety
82	82	Code, is amended by adding Section 1001.085 to read as follows:
83	83	Sec. 1001.085. TIER TWO FACILITY LOCATION INFORMATION. The
84	84	department shall provide the address or location of each facility
85	85	that is required to file a tier two form with the department to the
86	86	applicable regional planning commission or emergency communication
87	87	district.
88	88	SECTION 6. (a) The Commission on State Emergency
89	89	Communications shall adopt the performance standards relating to
90	90	automatic location identification and automatic tier two facility
91	91	identification as required by Section 771.051(a), Health and Safety
92	92	Code, as amended by this Act, not later than January 1, 2016.
93	93	(b) Each regional planning commission, as that term is
94	94	defined by Section 771.001, Health and Safety Code, shall submit an
95	95	amendment to that commission's regional plan not later than
96	96	February 1, 2016. The amendment must describe the procedures the
97	97	regional planning commission will use to fully implement automatic
98	98	tier two facility identification not later than March 1, 2016.
99	99	(c) An emergency communication district shall fully
100	100	implement automatic tier two facility identification as required by
101	101	Sections 771.0545 and 772.004, Health and Safety Code, as added by
102	102	this Act, not later than March 1, 2016.
103	103	(d) The Department of State Health Services shall provide
104	104	tier two facility location information as required by Section
105	105	1001.085, Health and Safety Code, as added by this Act, not later
106	106	than January 1, 2016.
107	107	SECTION 7. This Act takes effect immediately if it receives
108	108	a vote of two-thirds of all the members elected to each house, as
109	109	provided by Section 39, Article III, Texas Constitution. If this
110	110	Act does not receive the vote necessary for immediate effect, this
111	111	Act takes effect September 1, 2015.
