86 AN ACT
97 relating to a study on the effectiveness of regulations governing
108 the design and construction of certain Type I municipal solid waste
119 landfills overlying aquifers.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. (a) In this Act:
1412 (1) "Commission" means the Texas Commission on
1513 Environmental Quality.
1614 (2) "Landfill" means a Type I municipal solid waste
1715 landfill:
1816 (A) the entirety of which was designed and
1917 constructed in accordance with regulatory standards effective on or
2018 after October 9, 1993; and
2119 (B) that is not adjacent to a landfill that was
2220 designed and constructed in accordance with regulatory standards
2321 effective before October 9, 1993.
2422 (b) The commission shall conduct a study to determine the
2523 effectiveness of the regulations governing the design and
2624 construction of landfills located over aquifers in this state. The
2725 study must:
2826 (1) determine whether landfills located over aquifers
2927 are leaking;
3028 (2) based on a review of groundwater monitoring data
3129 collected and reported by statewide landfill operators and any
3230 other relevant information, determine if any leakage from landfills
3331 built over aquifers has seeped into or contaminated the groundwater
3432 underlying the landfills;
3533 (3) include any recommendations necessary for
3634 improving the effectiveness of the regulations governing the design
3735 and construction of landfills located over aquifers, including
3836 recommendations to:
3937 (A) prevent or reduce leakage from landfills
4038 overlying aquifers; and
4139 (B) protect aquifers underlying the landfills;
4240 and
4341 (4) be submitted for independent peer review.
4442 (c) The commission may work with other state agencies,
4543 institutions of higher education, nonprofit organizations, private
4644 organizations, or business entities to conduct the study.
4745 (d) Not later than January 1, 2017, the commission shall
4846 submit a report on the results and recommendations of the study to
4947 the governor, the lieutenant governor, the speaker of the house of
5048 representatives, and the presiding officer of each standing
5149 committee of the legislature with jurisdiction over environmental
5250 matters.
5351 (e) Applications and permits for Type I municipal solid
5452 waste landfills may not be postponed or delayed pending the results
5553 of the study.
5654 SECTION 2. This Act expires August 31, 2017.
5755 SECTION 3. This Act takes effect immediately if it receives
5856 a vote of two-thirds of all the members elected to each house, as
5957 provided by Section 39, Article III, Texas Constitution. If this
6058 Act does not receive the vote necessary for immediate effect, this
6159 Act takes effect September 1, 2015.
