88 AN ACT
99 relating to information on projected changes in weather, water
1010 availability, and climate variability in strategic plans of certain
1111 state agencies.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2056.002(b), Government Code, is amended
1414 to read as follows:
1515 (b) The Legislative Budget Board and the Governor's Office
1616 of Budget, Policy, and Planning shall determine the elements
1717 required to be included in each agency's strategic plan. Unless
1818 modified by the Legislative Budget Board and the Governor's Office
1919 of Budget, Policy, and Planning, and except as provided by
2020 Subsection (c), a plan must include:
2121 (1) a statement of the mission and goals of the state
2222 agency;
2323 (2) a description of the indicators developed under
2424 this chapter and used to measure the output and outcome of the
2525 agency;
2626 (3) identification of the groups of people served by
2727 the agency, including those having service priorities, or other
2828 service measures established by law, and estimates of changes in
2929 those groups expected during the term of the plan;
3030 (4) an analysis of the use of the agency's resources to
3131 meet the agency's needs, including future needs, and an estimate of
3232 additional resources that may be necessary to meet future needs;
3333 (5) an analysis of expected changes in the services
3434 provided by the agency because of changes in state or federal law;
3535 (6) a description of the means and strategies for
3636 meeting the agency's needs, including future needs, and achieving
3737 the goals established under Section 2056.006 for each area of state
3838 government for which the agency provides services;
3939 (7) a description of the capital improvement needs of
4040 the agency during the term of the plan and a statement, if
4141 appropriate, of the priority of those needs;
4242 (8) identification of each geographic region of this
4343 state, including the Texas-Louisiana border region and the
4444 Texas-Mexico border region, served by the agency, and if
4545 appropriate the agency's means and strategies for serving each
4646 region;
4747 (9) a description of the training of the agency's
4848 contract managers under Section 2262.053;
4949 (10) an analysis of the agency's expected expenditures
5050 that relate to federally owned or operated military installations
5151 or facilities, or communities where a federally owned or operated
5252 military installation or facility is located;
5353 (11) an analysis of the strategic use of information
5454 resources as provided by the instructions prepared under Section
5555 2054.095; [and]
5656 (12) for the Department of Agriculture, Texas
5757 Commission on Environmental Quality, General Land Office, Texas
5858 Department of Housing and Community Affairs, Texas Department of
5959 Insurance, Parks and Wildlife Department, Department of Public
6060 Safety, Public Utility Commission of Texas, office of the
6161 comptroller, Texas A&M Forest Service, and Texas Water Development
6262 Board:
6363 (A) an analysis of expected changes, including
6464 adverse impacts, in the services provided by the agency because of
6565 projected changes in weather, water availability, and climate
6666 variability, as determined by the Texas state climatologist's
6767 report under Section 2056.005(c);
6868 (B) for each period described in Section
6969 2056.005(c), a description of the means and strategies for meeting
7070 the agency's needs and managing the risks associated with the
7171 projected changes in weather, water availability, and climate
7272 variability as determined by the report; and
7373 (C) for the means and strategies described by
7474 Paragraph (B):
7575 (i) identification of any financial
7676 resources that will be needed to carry out those means and
7777 strategies; and
7878 (ii) an analysis of partnerships and
7979 cooperation between the agency and other state, local, and federal
8080 governmental entities that will be needed to carry out those means
8181 and strategies; and
8282 (13) other information that may be required.
8383 SECTION 2. Section 2056.005, Government Code, is amended by
8484 adding Subsections (c), (d), (e), and (f) to read as follows:
8585 (c) Not later than February 1 of each even-numbered year,
8686 the Texas state climatologist shall provide to the Legislative
8787 Budget Board, for use in the strategic planning of a state agency
8888 listed in Section 2056.002(b)(12), a report on projected changes in
8989 weather, water availability, and climate variability across the
9090 state for a period of:
9191 (1) five years beginning with the next odd-numbered
9292 year; and
9393 (2) at least 20 years and not longer than 50 years
9494 beginning with the next odd-numbered year.
9595 (d) The report under Subsection (c) may include:
9696 (1) projections of precipitation;
9797 (2) projections of temperature;
9898 (3) projections of stream flow in Texas rivers;
9999 (4) projections of evaporation rates;
100100 (5) projections of soil moisture rates;
101101 (6) projections of sea level changes;
102102 (7) projections of coastal storm intensity;
103103 (8) projections of inland and coastal flood intensity;
104104 (9) likely ranges of variability for all projections;
105105 (10) any estimations of the likelihood of the
106106 forecasts, as considered appropriate by the Texas state
107107 climatologist; and
108108 (11) any additional factors that are considered useful
109109 for state agency strategic planning by the Texas state
110110 climatologist.
111111 (e) The Texas state climatologist may use a forecast created
112112 outside of the office of the state climatologist if the forecast is
113113 considered suitable by the climatologist for the requirements of
114114 the report.
115115 (f) Not later than March 1 of each even-numbered year, the
116116 Legislative Budget Board shall distribute the report provided under
117117 Subsection (c) to the state agencies listed in Section
118118 2056.002(b)(12) for use in each agency's strategic planning.
119119 SECTION 3. This Act takes effect September 1, 2015.
