88 AN ACT
99 relating to the movement of oil well servicing and drilling
1010 machinery on public highways; authorizing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 623.145, Transportation Code, is amended
1313 by amending Subsection (a) and adding Subsections (c) and (d) to
1414 read as follows:
1515 (a) The board, in consultation with the commission, by rule
1616 shall provide for the issuance of permits under this
1717 subchapter. The rules must include each matter the board and
1818 commission determine necessary to implement this subchapter and:
1919 (1) requirements for forms and procedures used in
2020 applying for a permit;
2121 (2) conditions with regard to route and time of
2222 movement;
2323 (3) requirements for flags, flaggers, and warning
2424 devices;
2525 (4) a determination regarding whether the department
2626 will issue a sticker to be placed on the vehicle to indicate the
2727 issuance of the permit;
2828 (5) the fee for a permit; and
2929 (6) [(5)] standards to determine whether a permit is
3030 to be issued for one trip only or for a period established by the
3131 commission.
3232 (c) In addition to any other permits established by rule
3333 under this subchapter, the board shall adopt a rule authorizing an
3434 annual permit for a vehicle with a maximum gross weight of more than
3535 80,000 pounds. The annual permit must specify the permitted axle
3636 weight for the vehicle and the permitted gross weight for the
3737 vehicle, which may not exceed 135,000 pounds. The fee for the
3838 annual permit may not exceed $2,000.
3939 (d) The axle weight and gross weight allowed under an annual
4040 permit authorized under Subsection (c) may not exceed the maximum
4141 allowable weight provided by board rule for the vehicle, plus a
4242 tolerance allowance of:
4343 (1) five percent of the allowable axle weight; and
4444 (2) five percent of the allowable gross weight, except
4545 that the sum of the maximum gross weight for the vehicle and the
4646 gross weight tolerance may not exceed 135,000 pounds.
4747 SECTION 2. This Act takes effect September 1, 2015.
