| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 623.145, Transportation Code, is amended |
|---|
| 13 | 13 | | by amending Subsection (a) and adding Subsections (c) and (d) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (a) The board, in consultation with the commission, by rule |
|---|
| 16 | 16 | | shall provide for the issuance of permits under this |
|---|
| 17 | 17 | | subchapter. The rules must include each matter the board and |
|---|
| 18 | 18 | | commission determine necessary to implement this subchapter and: |
|---|
| 19 | 19 | | (1) requirements for forms and procedures used in |
|---|
| 20 | 20 | | applying for a permit; |
|---|
| 21 | 21 | | (2) conditions with regard to route and time of |
|---|
| 22 | 22 | | movement; |
|---|
| 23 | 23 | | (3) requirements for flags, flaggers, and warning |
|---|
| 24 | 24 | | devices; |
|---|
| 25 | 25 | | (4) a determination regarding whether the department |
|---|
| 26 | 26 | | will issue a sticker to be placed on the vehicle to indicate the |
|---|
| 27 | 27 | | issuance of the permit; |
|---|
| 28 | 28 | | (5) the fee for a permit; and |
|---|
| 29 | 29 | | (6) [(5)] standards to determine whether a permit is |
|---|
| 30 | 30 | | to be issued for one trip only or for a period established by the |
|---|
| 31 | 31 | | commission. |
|---|
| 32 | 32 | | (c) In addition to any other permits established by rule |
|---|
| 33 | 33 | | under this subchapter, the board shall adopt a rule authorizing an |
|---|
| 34 | 34 | | annual permit for a vehicle with a maximum gross weight of more than |
|---|
| 35 | 35 | | 80,000 pounds. The annual permit must specify the permitted axle |
|---|
| 36 | 36 | | weight for the vehicle and the permitted gross weight for the |
|---|
| 37 | 37 | | vehicle, which may not exceed 135,000 pounds. The fee for the |
|---|
| 38 | 38 | | annual permit may not exceed $2,000. |
|---|
| 39 | 39 | | (d) The axle weight and gross weight allowed under an annual |
|---|
| 40 | 40 | | permit authorized under Subsection (c) may not exceed the maximum |
|---|
| 41 | 41 | | allowable weight provided by board rule for the vehicle, plus a |
|---|
| 42 | 42 | | tolerance allowance of: |
|---|
| 43 | 43 | | (1) five percent of the allowable axle weight; and |
|---|
| 44 | 44 | | (2) five percent of the allowable gross weight, except |
|---|
| 45 | 45 | | that the sum of the maximum gross weight for the vehicle and the |
|---|
| 46 | 46 | | gross weight tolerance may not exceed 135,000 pounds. |
|---|
| 47 | 47 | | SECTION 2. This Act takes effect September 1, 2015. |
