24	4		AN ACT
25	5		relating to the abolishment of certain programs administered by the
26	6		Texas Economic Development Bank.
27	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
28	8		SECTION 1. The following laws are repealed:
29	9		(1) Subchapter N, Chapter 481, Government Code; and
30	10		(2) Chapter 503, Local Government Code.
31	11		SECTION 2. Section 447.013(i), Government Code, is amended
32	12		to read as follows:
33	13		(i) A recipient of a grant or loan under this section is
34	14		encouraged to purchase goods and services from small businesses and
35	15		historically underutilized businesses, as those terms are defined
36	16		by former Section 481.191, as that section existed on January 1,
37	17		2015 [Government Code].
38	18		SECTION 3. Section 489.108, Government Code, is amended to
39	19		read as follows:
40	20		Sec. 489.108. PROGRAMS, SERVICES, AND FUNDS UNDER BANK'S
41	21		DIRECTION. Notwithstanding any other law, the bank shall perform
42	22		the duties and functions of the office with respect to the following
43	23		programs, services, and funds:
44	24		(1) [the Texas Small Business Industrial Development
45	25		Corporation established under Chapter 503, Local Government Code;
46	26		[(2)] the capital access program established under
47	27		Section 481.405;
48	28		(2) [(3)] the Texas leverage fund;
49	29		(3) [(4) the linked deposit program established under
50	30		Section 481.193;
51	31		[(5)] the enterprise zone program established under
52	32		Chapter 2303;
53	33		(4) [(6)] the industrial revenue bond program;
54	34		(5) [(7)] the defense economic readjustment zone
55	35		program established under Chapter 2310;
56	36		(6) [(8)] the Empowerment Zone and Enterprise
57	37		Community grant program established under Section 481.025; and
58	38		(7) [(9)] the renewal community program.
59	39		SECTION 4. Section 39.909(a), Utilities Code, is amended to
60	40		read as follows:
61	41		(a) In this section, "small business" and "historically
62	42		underutilized business" have the meanings assigned by former
63	43		Section 481.191, Government Code, as that section existed on
64	44		January 1, 2015.
65	45		SECTION 5. Section 52.256(a), Utilities Code, is amended to
66	46		read as follows:
67	47		(a) In this section, "small business" and "historically
68	48		underutilized business" have the meanings assigned by former
69	49		Section 481.191, Government Code, as that section existed on
70	50		January 1, 2015.
71	51		SECTION 6. (a) The Texas Economic Development Bank shall
72	52		reject any application for a linked deposit loan submitted to the
73	53		bank before the effective date of this Act for which a linked
74	54		deposit has not been made in accordance with Subchapter N, Chapter
75	55		481, Government Code, as that subchapter existed immediately before
76	56		being repealed by this Act.
77	57		(b) Notwithstanding the repeal by this Act of Subchapter N,
78	58		Chapter 481, Government Code, Subchapter N is continued in effect
79	59		for the limited purpose of allowing the Texas Economic Development
80	60		Bank to administer linked deposits made before the effective date
81	61		of this Act and to pursue the bank's remedies under that subchapter
82	62		if:
83	63		(1) a recipient of a loan to which a deposit is linked
84	64		defaults on the loan; or
85	65		(2) a lending institution that makes a loan for which a
86	66		linked deposit is made fails to comply with that subchapter.
87	67		SECTION 7. As soon as practicable after the effective date
88	68		of this Act, the Texas Economic Development Bank shall send to the
89	69		comptroller for deposit in the general revenue fund any revenue or
90	70		other money of the Texas Small Business Industrial Development
91	71		Corporation held in financial institutions as provided by Section
92	72		503.055, Local Government Code, as that section existed immediately
93	73		before that section's repeal by this Act.
94	74		SECTION 8. This Act takes effect September 1, 2015.
