| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 372.0035(a), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) This section applies only to: |
|---|
| 13 | 13 | | (1) a municipality that: |
|---|
| 14 | 14 | | (A) has a population of more than 750,000 and |
|---|
| 15 | 15 | | less [one million and a council-manager form of government and that |
|---|
| 16 | 16 | | is located wholly or partly in a county with a population of more] |
|---|
| 17 | 17 | | than two million; or |
|---|
| 18 | 18 | | (B) has a population of more than 325,000 and |
|---|
| 19 | 19 | | less than 625,000; and |
|---|
| 20 | 20 | | (2) a public improvement district established under |
|---|
| 21 | 21 | | this subchapter and solely composed of territory in which the only |
|---|
| 22 | 22 | | businesses are: |
|---|
| 23 | 23 | | (A) hotels with 100 or more rooms ordinarily used |
|---|
| 24 | 24 | | for sleeping, if the district is established by a municipality |
|---|
| 25 | 25 | | described by Subdivision (1)(A); or |
|---|
| 26 | 26 | | (B) hotels with 75 or more rooms ordinarily used |
|---|
| 27 | 27 | | for sleeping, if the district is established by a municipality |
|---|
| 28 | 28 | | described by Subdivision (1)(B). |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2015. |
