115 relating to the qualifications for teaching a driver education
126 course.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 521.205(a), Transportation Code, is
159 amended to read as follows:
1610 (a) The department by rule shall provide for approval of a
1711 driver education course conducted by the parent, stepparent, foster
1812 parent, legal guardian, step-grandparent, or grandparent of a
1913 person who is required to complete a driver education course to
2014 obtain a Class C license. The rules must provide that:
2115 (1) the person conducting the course possess a valid
2216 license for the preceding three years that has not been suspended,
2317 revoked, or forfeited in the past three years for an offense that
2418 involves the operation of a motor vehicle;
2519 (2) the student driver spend a minimum number of hours
2620 in:
2721 (A) classroom instruction; and
2822 (B) behind-the-wheel instruction;
2923 (3) the person conducting the course not be convicted
3024 of:
3125 (A) criminally negligent homicide; or
3226 (B) driving while intoxicated; and
3327 (4) [the person conducting the course not be disabled
3428 because of mental illness; and
3529 [(5)] the person conducting the course not have six or
3630 more points assigned to the person's driver's license under
3731 Subchapter B, Chapter 708, at the time the person begins conducting
3832 the course.
3933 SECTION 2. This Act takes effect immediately if it receives
4034 a vote of two-thirds of all the members elected to each house, as
4135 provided by Section 39, Article III, Texas Constitution. If this
4236 Act does not receive the vote necessary for immediate effect, this
4337 Act takes effect September 1, 2015.
