| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 521.205(a), Transportation Code, is |
|---|
| 15 | 9 | | amended to read as follows: |
|---|
| 16 | 10 | | (a) The department by rule shall provide for approval of a |
|---|
| 17 | 11 | | driver education course conducted by the parent, stepparent, foster |
|---|
| 18 | 12 | | parent, legal guardian, step-grandparent, or grandparent of a |
|---|
| 19 | 13 | | person who is required to complete a driver education course to |
|---|
| 20 | 14 | | obtain a Class C license. The rules must provide that: |
|---|
| 21 | 15 | | (1) the person conducting the course possess a valid |
|---|
| 22 | 16 | | license for the preceding three years that has not been suspended, |
|---|
| 23 | 17 | | revoked, or forfeited in the past three years for an offense that |
|---|
| 24 | 18 | | involves the operation of a motor vehicle; |
|---|
| 25 | 19 | | (2) the student driver spend a minimum number of hours |
|---|
| 26 | 20 | | in: |
|---|
| 27 | 21 | | (A) classroom instruction; and |
|---|
| 28 | 22 | | (B) behind-the-wheel instruction; |
|---|
| 29 | 23 | | (3) the person conducting the course not be convicted |
|---|
| 30 | 24 | | of: |
|---|
| 31 | 25 | | (A) criminally negligent homicide; or |
|---|
| 32 | 26 | | (B) driving while intoxicated; and |
|---|
| 33 | 27 | | (4) [the person conducting the course not be disabled |
|---|
| 34 | 28 | | because of mental illness; and |
|---|
| 35 | 29 | | [(5)] the person conducting the course not have six or |
|---|
| 36 | 30 | | more points assigned to the person's driver's license under |
|---|
| 37 | 31 | | Subchapter B, Chapter 708, at the time the person begins conducting |
|---|
| 38 | 32 | | the course. |
|---|
| 39 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 40 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 37 | | Act takes effect September 1, 2015. |
