| 11 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 10 | | SECTION 1. Subchapter A, Chapter 411, Government Code, is |
|---|
| 13 | 11 | | amended by adding Section 411.0094 to read as follows: |
|---|
| 14 | 12 | | Sec. 411.0094. AUTOMATIC LICENSE PLATE READER. (a) In this |
|---|
| 15 | 13 | | section, "automatic license plate reader" means a system that reads |
|---|
| 16 | 14 | | and records license plate numbers taken from digital photographs. |
|---|
| 17 | 15 | | (b) A law enforcement agency, or a municipal parking |
|---|
| 18 | 16 | | enforcement authority that employs or uses the services of |
|---|
| 19 | 17 | | civilians, may use an automatic license plate reader. |
|---|
| 20 | 18 | | (c) All images and data produced from an automatic license |
|---|
| 21 | 19 | | plate reader under this section shall be destroyed not later than |
|---|
| 22 | 20 | | one year after the date of collection unless the image or data is |
|---|
| 23 | 21 | | evidence in a civil action or a criminal investigation or |
|---|
| 24 | 22 | | prosecution. |

| 25 | 23 | | SECTION 2. This Act takes effect September 1, 2015. |
