124 AN ACT
135 relating to a study of the current and potential economic impacts of
146 recycling.
157 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
168 SECTION 1. DEFINITIONS. In this Act:
179 (1) "Commission" means the Texas Commission on
1810 Environmental Quality.
1911 (2) "Recycling" has the meaning assigned by Section
2012 361.421, Health and Safety Code.
2113 SECTION 2. STUDY OF ECONOMIC IMPACTS OF RECYCLING. (a) The
2214 commission shall conduct a study on the current and potential
2315 economic impacts of recycling, including state and local revenue
2416 that may be considered lost because recyclable materials are not
2517 recycled. The study must:
2618 (1) assess current recycling efforts, including by:
2719 (A) quantifying the amount of materials
2820 currently being recycled;
2921 (B) assessing the cost, value, and quality of
3022 materials currently being recycled; and
3123 (C) estimating the amount of materials that could
3224 be recycled but are not currently being recycled;
3325 (2) identify methods that may be used, by the public
3426 sector, the private sector, or both, to increase recycling,
3527 including through the development of:
3628 (A) new markets for recycled materials; and
3729 (B) new businesses that may result from
3830 recycling;
3931 (3) investigate the current and potential
4032 availability of funding for the methods identified under
4133 Subdivision (2);
4234 (4) assess the current types and number of jobs
4335 associated with recycling and potential additional opportunities
4436 for job creation that may result from increased recycling; and
4537 (5) assess infrastructure needs and development
4638 opportunities associated with recycling in rural areas.
4739 (b) To the extent practicable, the commission shall use
4840 methodologies developed for other recycling studies performed in
4941 this state in performing the study under this section.
5042 (c) The commission shall prepare a written report on the
5143 results of the study and include the report in the 2016 summary
5244 report titled "Municipal Solid Waste in Texas: A Year in Review."
5345 SECTION 3. EXPIRATION. This Act expires August 31, 2017.
5446 SECTION 4. EFFECTIVE DATE. This Act takes effect
5547 immediately if it receives a vote of two-thirds of all the members
5648 elected to each house, as provided by Section 39, Article III, Texas
5749 Constitution. If this Act does not receive the vote necessary for
5850 immediate effect, this Act takes effect September 1, 2015.
