 A BILL TO BE ENTITLED
 AN ACT
 relating to prohibiting the establishment of a health benefit
 exchange for purposes of certain federal law.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Title 8, Insurance Code, is amended by adding
 Subtitle L to read as follows:
 SUBTITLE L. FEDERAL PATIENT PROTECTION AND AFFORDABLE CARE ACT
 CHAPTER 1691. HEALTH BENEFIT EXCHANGE
 Sec. 1691.001.  HEALTH BENEFIT EXCHANGE PROHIBITED. A
 health benefit exchange described in the Patient Protection and
 Affordable Care Act (Pub. L. No. 111-148), as amended by the Health
 Care and Education Reconciliation Act of 2010 (Pub. L.
 No. 111-152), may not be established in this state.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2015.
