55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of the board of trustees of certain
88 independent school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 11, Education Code, is
1111 amended by adding Section 11.0521 to read as follows:
1212 Sec. 11.0521. INCREASE IN NUMBER OF SINGLE-MEMBER TRUSTEE
1313 DISTRICTS IN CERTAIN DISTRICTS REQUIRED. (a) This section applies
1414 only to an independent school district with a student enrollment of
1515 more than 200,000.
1616 (b) Notwithstanding Section 11.051(b), the board of
1717 trustees of an independent school district subject to this section
1818 shall by resolution increase the membership of the board to 17. The
1919 resolution shall order that the additional members are to be
2020 elected from single-member trustee districts.
2121 (c) The resolution shall redivide the district into 17
2222 trustee districts in accordance with the requirements of Section
2323 11.052(f).
2424 (d) Except as provided by Subsection (e), positions on the
2525 board shall be filled at the first regular election of trustees that
2626 occurs after the adoption of the resolution. The trustees then
2727 elected:
2828 (1) shall draw lots for staggered terms as provided by
2929 Section 11.059; and
3030 (2) must comply with the residency requirements of
3131 Section 11.052(g).
3232 (e) The position of a trustee in office when the resolution
3333 is adopted shall be filled as the staggered terms of the trustees
3434 then in office expire. A person's eligibility to serve as a trustee
3535 is not affected by a boundary change made under Subsection (c) that:
3636 (1) removes the person's residence from the trustee
3737 district the person serves; and
3838 (2) takes effect during the term for which the person
3939 was elected or appointed.
4040 SECTION 2. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2015.
