| 7 | 7 | | relating to the composition of the board of trustees of certain |
|---|
| 8 | 8 | | independent school districts. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 11, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 11.0521 to read as follows: |
|---|
| 12 | 12 | | Sec. 11.0521. INCREASE IN NUMBER OF SINGLE-MEMBER TRUSTEE |
|---|
| 13 | 13 | | DISTRICTS IN CERTAIN DISTRICTS REQUIRED. (a) This section applies |
|---|
| 14 | 14 | | only to an independent school district with a student enrollment of |
|---|
| 15 | 15 | | more than 200,000. |
|---|
| 16 | 16 | | (b) Notwithstanding Section 11.051(b), the board of |
|---|
| 17 | 17 | | trustees of an independent school district subject to this section |
|---|
| 18 | 18 | | shall by resolution increase the membership of the board to 17. The |
|---|
| 19 | 19 | | resolution shall order that the additional members are to be |
|---|
| 20 | 20 | | elected from single-member trustee districts. |
|---|
| 21 | 21 | | (c) The resolution shall redivide the district into 17 |
|---|
| 22 | 22 | | trustee districts in accordance with the requirements of Section |
|---|
| 23 | 23 | | 11.052(f). |
|---|
| 24 | 24 | | (d) Except as provided by Subsection (e), positions on the |
|---|
| 25 | 25 | | board shall be filled at the first regular election of trustees that |
|---|
| 26 | 26 | | occurs after the adoption of the resolution. The trustees then |
|---|
| 27 | 27 | | elected: |
|---|
| 28 | 28 | | (1) shall draw lots for staggered terms as provided by |
|---|
| 29 | 29 | | Section 11.059; and |
|---|
| 30 | 30 | | (2) must comply with the residency requirements of |
|---|
| 31 | 31 | | Section 11.052(g). |
|---|
| 32 | 32 | | (e) The position of a trustee in office when the resolution |
|---|
| 33 | 33 | | is adopted shall be filled as the staggered terms of the trustees |
|---|
| 34 | 34 | | then in office expire. A person's eligibility to serve as a trustee |
|---|
| 35 | 35 | | is not affected by a boundary change made under Subsection (c) that: |
|---|
| 36 | 36 | | (1) removes the person's residence from the trustee |
|---|
| 37 | 37 | | district the person serves; and |
|---|
| 38 | 38 | | (2) takes effect during the term for which the person |
|---|
| 39 | 39 | | was elected or appointed. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2015. |
