84R543 PAM-D By: Thompson of Harris H.B. No. 289 A BILL TO BE ENTITLED AN ACT relating to the composition of the board of trustees of certain independent school districts. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter C, Chapter 11, Education Code, is amended by adding Section 11.0521 to read as follows: Sec. 11.0521. INCREASE IN NUMBER OF SINGLE-MEMBER TRUSTEE DISTRICTS IN CERTAIN DISTRICTS REQUIRED. (a) This section applies only to an independent school district with a student enrollment of more than 200,000. (b) Notwithstanding Section 11.051(b), the board of trustees of an independent school district subject to this section shall by resolution increase the membership of the board to 17. The resolution shall order that the additional members are to be elected from single-member trustee districts. (c) The resolution shall redivide the district into 17 trustee districts in accordance with the requirements of Section 11.052(f). (d) Except as provided by Subsection (e), positions on the board shall be filled at the first regular election of trustees that occurs after the adoption of the resolution. The trustees then elected: (1) shall draw lots for staggered terms as provided by Section 11.059; and (2) must comply with the residency requirements of Section 11.052(g). (e) The position of a trustee in office when the resolution is adopted shall be filled as the staggered terms of the trustees then in office expire. A person's eligibility to serve as a trustee is not affected by a boundary change made under Subsection (c) that: (1) removes the person's residence from the trustee district the person serves; and (2) takes effect during the term for which the person was elected or appointed. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2015.
