| 11 | 5 | | relating to the election of certain county bail bond board members. |

| 12 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 7 | | SECTION 1. Section 1704.0535, Occupations Code, is amended |
|---|
| 14 | 8 | | to read as follows: |
|---|
| 15 | 9 | | Sec. 1704.0535. ELECTION OF CERTAIN BAIL BOND [SURETY] |
|---|
| 16 | 10 | | BOARD MEMBERS [MEMBER]. (a) The board shall annually conduct a |
|---|
| 17 | 11 | | secret ballot election to elect the members [member] of the board |
|---|
| 18 | 12 | | who serve [serves] as the representative of licensed bail bond |
|---|
| 19 | 13 | | sureties and the representative of the criminal defense attorneys |
|---|
| 20 | 14 | | by electing: |
|---|
| 21 | 15 | | (1) a licensed bail bond surety or agent for a |
|---|
| 22 | 16 | | corporate surety board member; and |
|---|
| 23 | 17 | | (2) a criminal defense attorney who is practicing in |
|---|
| 24 | 18 | | the county. |
|---|
| 25 | 19 | | (b) Each individual licensed in the county as a bail bond |
|---|
| 26 | 20 | | surety or agent for a corporate surety is entitled to cast one vote |
|---|
| 27 | 21 | | for each license held to elect the board member who is a surety or |
|---|
| 28 | 22 | | agent for a corporate surety. |
|---|
| 29 | 23 | | (c) Each attorney who has a principal place of business |
|---|
| 30 | 24 | | located in the county and who is not legally prohibited from |
|---|
| 31 | 25 | | representing criminal defendants in the county is entitled to cast |
|---|
| 32 | 26 | | one vote to elect the board member who is a criminal defense |
|---|
| 33 | 27 | | attorney. |
|---|
| 34 | 28 | | (d) Each elected justice of the peace in the county who is |
|---|
| 35 | 29 | | not legally prohibited from voting in an election for the purpose is |
|---|
| 36 | 30 | | entitled to cast one vote to elect the board member who is a justice |
|---|
| 37 | 31 | | of the peace. |
|---|
| 38 | 32 | | SECTION 2. The changes in law made by this Act regarding the |
|---|
| 39 | 33 | | election of certain county bail bond board members do not affect the |
|---|
| 40 | 34 | | entitlement of a member serving on a board immediately before the |
|---|
| 41 | 35 | | effective date of this Act to continue to serve and function as a |
|---|
| 42 | 36 | | member of the board for the remainder of the member's term. Those |
|---|
| 43 | 37 | | changes in law apply only to a member elected on or after the |
|---|
| 44 | 38 | | effective date of this Act. |

| 45 | 39 | | SECTION 3. This Act takes effect September 1, 2015. |
