| 8 | 8 | | transport agricultural products of an overweight vehicle permit. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 12, Agriculture Code, is amended by |
|---|
| 11 | 11 | | adding Section 12.051 to read as follows: |
|---|
| 12 | 12 | | Sec. 12.051. NOTICE CONCERNING AVAILABILITY OF OVERWEIGHT |
|---|
| 13 | 13 | | VEHICLE PERMIT. (a) The department shall provide information about |
|---|
| 14 | 14 | | the permit issued under Section 623.011, Transportation Code, and |
|---|
| 15 | 15 | | the availability to persons who transport agricultural products of |
|---|
| 16 | 16 | | that permit: |
|---|
| 17 | 17 | | (1) on the department's Internet website; and |
|---|
| 18 | 18 | | (2) in any department publication related to the |
|---|
| 19 | 19 | | production, processing, storage, or delivery of an agricultural |
|---|
| 20 | 20 | | product, the transportation of which may require that permit. |
|---|
| 21 | 21 | | (b) The department shall adopt rules to: |
|---|
| 22 | 22 | | (1) provide the form and content of a notice |
|---|
| 23 | 23 | | concerning the permit issued under Section 623.011, Transportation |
|---|
| 24 | 24 | | Code, and the availability to persons who transport agricultural |
|---|
| 25 | 25 | | products of that permit; and |
|---|
| 26 | 26 | | (2) require facilities involved in the production, |
|---|
| 27 | 27 | | processing, storage, or delivery of an agricultural product, the |
|---|
| 28 | 28 | | transportation of which may require that permit, to post the notice |
|---|
| 29 | 29 | | in the facility. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2015. |
